In the letter, the Environmental Health Division(EHD) requested that a <br /> Remediation Plan for Methane Gas Releases be submitted along with a history of recent work <br /> performed on the gas control system. Also, on the inspection report dated June 26, 2000, <br /> performed by Rodney Estrada, a violation was recorded for Section 21160 of Title 27, California <br /> Code of Regulations. We do not believe we are in violation of the stated section as described <br /> below. A discussion of modifications to the gas system is also included. <br /> Section 21160 reads as follows: <br /> 321160. CIWMB -Landfill Gas Control and Leachate Contact. <br /> (a) The operator shall implement and maintain landfill gas control and prevent leachate contact <br /> with the public or animals according to the requirements of this section. <br /> (b) Gas monitoring and control shall be conducted during the closure and postclosure <br /> maintenance period pursuant to Article 6, Subchapter 4 of this chapter. <br /> (c)During the closure/postclosure maintenance period, the owner/operator shall ensure that <br /> leachate collection and control is done in a manner which prevents public contact and controls <br /> vectors, nuisance and odors. <br /> (d) In designing the LCRS to meet the requirements under 320340, the owner/operator shall <br /> also assure that the LCRS neither: <br /> (1) interferes with landfill gas control; nor <br /> (2) promotes landfill gas migration. <br />
