1 <br />I <br />a pledge of revenue as an acceptable mechanism to demonstrate <br />2 <br />financial responsibility for postclosure maintenance activities of <br />3 <br />a solid waste landfill; and <br />4 <br />WHEREAS, the COUNTY established by Resolution #R-74-3362 dated <br />5- <br />November 26, 1974, the Solid Waste Enterprise Fund to ensure <br />6 <br />adequate resources for operating expenses for the COUNTY owned and <br />7 <br />operated refuse disposal facilities; and <br />8 <br />'WHEREAS,.the COUNTY is responsible for the administration -of <br />9 <br />said fund; and <br />10 <br />WHEREAS, the COUNTY has determined that projected net revenues <br />derived from fees for the use of the <br />11 <br />from said fund, user charged <br />12 <br />COUNTY's solid waste facilities which include: the North County <br />13 <br />Recycling Center and Sanitary Landfill (39 -AA -0022), the Foothill <br />14 <br />Sanitary Landfill (39 -AA -0004), the Corral Hollow Sanitary Landfill: <br />15 <br />(39 -AA -0005) , and' the Lovelace—Transfer—�-�ti==aa <br />16 <br />during the thirty (30) year period of postclosure maintenance of <br />17 <br />the LANDFILL shall be greater during each year of this period than <br />18 <br />the yearly monitoring and postclosure maintenance cost contained in <br />19 <br />the most recent cost estimate for the LANDFILL, which has been " <br />20 <br />submitted to the BOARD in accordance with Section -18266 of the <br />21 <br />Regulations; <br />22,. <br />NOW, THEREFORE, the parties hereto mutually agree as follows: <br />23 <br />1. The COUNTY hereby establishes a pledge 'of revenue as the <br />l <br />24 <br />financial mechanism for postclosure maintenance of the <br />25 <br />LANDFILL in accordance with Sections 18283 and 18290 of the <br />2 <br />
