it <br />11 <br />11 <br />I. <br />Regulations to replace the LANDFILL's Solid Waste Closure <br />2 <br />Enterprise Fund mechanism.which was established to provide for <br />3 <br />both closure and postclosure maintenance.. <br />4 <br />2. <br />The COUNTY shall transfer funds.that.were previously dedicated <br />5 <br />for postclosure maintenance of the LANDFILL in the Solid Waste <br />6 <br />Closure Enterprise Fund to the subbudget unit for the LANDFILL <br />7 <br />closure activities commencing in 1993. <br />8 <br />3. <br />The COUNTY agrees to pledge net revenues from the Solid Waste <br />9 <br />Enterprise Fund as described herein. <br />10 <br />4. <br />The amount of the pledged revenue shall be equal to the <br />11 <br />approved postclosure maintenance cost of $75,980 -per year for <br />12 <br />the thirty (30) year period of postclosure _maintenance, - <br />13 <br />representing. the, most recent .monitoring and postclosure <br />14 <br />maintenance. cost estimate for the;LANDFILL. :It is agreed that <br />15 <br />the amount of this -pledge may. -increase or decrease to match <br />16 <br />any adjustment to. the identified cost estimate which is <br />17 <br />mutually agreed to by the COUNTY and the BOARD. <br />18 <br />5. <br />If the COUNTY -ceases at any time to retain control of its <br />19 <br />ability to allocate the pledged revenue as identified herein <br />20 <br />to pay postclosure maintenance costs, the COUNTY shall notify <br />21 <br />the BOARD and the local enforcement agency and shall obtain <br />22 <br />alternate coverage within sixty (60) days after the control of <br />23 <br />funds lapses, pursuant to Section 18290 of the Regulations.. <br />24 <br />6. <br />In the. event that the BOARD determines that the COUNTY has. <br />25 <br />failed or, is. failing to perform postclosure maintenance as <br />26 <br />required by law, the BOARD may direct the Auditor Controller <br />
