f <br />May 4, 1992 <br />File: 24-215600-E03 <br />Mr. David Sadwick <br />Heller, Ehrman, White McAuliffe <br />601 South Figueroa Street, 40th Floor <br />Los Angeles, California 90017-5758 <br />SUBJECT: Cove Contractors Landfill Site <br />Dear Mr. Sadwick: <br />We received a fax from you on March 26, 1992 which consisted of a copy of a landfill <br />inspection report prepared by Mr. Steven Sasson of the San Joaquin County Environmental <br />Health Division, the local enforcement agency for the California Integrated Waste <br />Management Board. At your request, we have prepared this letter which is a response to the <br />comments in the inspection report <br />Comment 1: <br />17678- The wall of the excavation is at a 90° angle. The slope of the working face <br />shall not exceed a 301 angle. <br />Response: <br />Section 17678 of Title 14, California Code of Regulations, states: <br />"The slope of the working face shall be maintained at the ratio which will allow <br />effective compaction of the wastes. The depth of cuts and slopes of trench sides shall <br />not exceed horizontal to vertical ratios as approved by the Enforcement Agency. " <br />When filling operations resume at the landfill, the slope of the active face will be kept at a <br />slope of less than 30 degrees. The pre-existing cut slope on the northern edge of the site is <br />native material, will not be used as a "working face", and thus does not violate 14 CCR § <br />17678. Sections A-4 and G-1 of the Kleinfeider "Report of Disposal Site Information, Cove <br />Contractors Site" dated July 11, 1990 describes how construction and fill operations in the <br />vicinity of the soil wall will be limited and conform to Section 1926.650, Subpart P, Part <br />1926, 29 Code of Federal Regulations.
