We have instructed Kleinfelder, Inc. to prepare a grading plan for the site showing existing and proposed topography, directional flow of storm water, and placement and thickness of cover. We have also instructed Kleinfelder to prepare an amendment to the Report of Disposal Site Information ("RDSI") to reflect our current plans for the site. We agree to your $78.00 per hour fee to review the RDSI and activities ancillary to the quarterly inspections, however, we would appreciate receiving from you in advance your best estimate of the amount of fees you anticipate. In addition we would like to be notified if the estimate will be exceeded. It is our understanding that the fees are not retro -active. With respect to the notice of inspection dated March 4, 1993, prepared by Mr. Steven Sasson of your staff we note that this inspection notice should not be considered as documenting either new or continuing violations by us for the following reasons: (a) As previously demonstrated by a letter dated May 4, 1992 prepared by Kleinfelder and submitted to the County, there is a sound basis for not considering these conditions to constitute violations. We have been discussing these issues with the County and believe that we are reaching agreement on these issues. (b) We are and were even prior to the inspection of March 4, 1993 willing to address conditions at the site in an appropriate manner, as is demonstrated by (among other things) by my letter of March 3, 1993 to Mr. Sasson;
