We have instructed <br />Kleinfelder, Inc. to prepare a grading plan for the site <br />showing existing and proposed topography, directional flow of <br />storm water, and placement and thickness of cover. <br />We have also instructed Kleinfelder to prepare an amendment <br />to the Report of Disposal Site Information ("RDSI") to <br />reflect our current plans for the site. We agree to your <br />$78.00 per hour fee to review the RDSI and activities <br />ancillary to the quarterly inspections, however, we would <br />appreciate receiving from you in advance your best estimate <br />of the amount of fees you anticipate. In addition we would <br />like to be notified if the estimate will be exceeded. It is <br />our understanding that the fees are not retro -active. <br />With respect to the notice of inspection dated March 4, 1993, <br />prepared by Mr. Steven Sasson of your staff we note that this <br />inspection notice should not be considered as documenting <br />either new or continuing violations by us for the following <br />reasons: <br />(a) As previously demonstrated by a letter dated May <br />4, 1992 prepared by Kleinfelder and submitted to <br />the County, there is a sound basis for not <br />considering these conditions to constitute <br />violations. We have been discussing these issues <br />with the County and believe that we are reaching <br />agreement on these issues. <br />(b) We are and were even prior to the inspection of <br />March 4, 1993 willing to address conditions at <br />the site in an appropriate manner, as is <br />demonstrated by (among other things) by my letter <br />of March 3, 1993 to Mr. Sasson; <br />
