Background on Cove's Facility <br />Cove's California Clay Landfill located in Stockton, <br />California (the "Facility"), is currently permitted under Permit <br />No. 39 -AA -010 (the "Permit"), originally issued by PHS on <br />November 16, 1979, to accept auto shredder waste ("ASW") and <br />other inert construction materials at the Facility.!' Although <br />Cove is not presently accepting ASW, Cove is awaiting receipt of <br />new waste discharge requirements from the California Regional <br />Water Quality Control Board ("Water Board") prior to continuing <br />its landfilling of ASW and inert waste at the Facility. Cove <br />will continue exactly the same landfilling operations authorized <br />by the Permit at this Facility upon receipt of the Water Board's <br />new waste discharge requirements. <br />As you can see from our attached Exhibit 2, the Permit <br />has been lawfully renewed for the 1991-92 fiscal year. Prior to <br />its latest renewal, Cove submitted to PHS and the Water Board, <br />inter alia, the following documents: <br />(1) An application for a five-year permit review (filed <br />January 10, 1991), <br />(2) A Report of Disposal Site Information (submitted <br />January 3, 1991), <br />(3) A Periodic Site Review Report (submitted January 3, <br />1991), and <br />2/ These exhibits include the following: <br />1. Solid Waste Facilities Permit # 39 -AA -010 issued <br />November 16, 1979; <br />2. Environmental Health Permit Renewal Notice issued July <br />11, 1991; <br />3. Letter from you to Mr. Jack Hecht dated August 13, <br />1990; <br />4. Letter from Mr. Robert Ching to Mr. Mark Urquhart dated <br />June 11, 1990, with attached letters to Mr. Ching from <br />Roger Lane Carrick dated February 9, 1990, and from <br />Mark Urquhart dated May 17, 1990; <br />5. Letters from Mark Urquhart to Steve Sasson dated <br />October 9, 1991; and <br />6. Summary of PHS's comments and Cove Contractor's <br />responses to comments on the Report of Disposal Site <br />Information and the Periodic Site Review Report. <br />3/ See Exhibits 1, 2 and 3. <br />
