California <br />Dear Mr. Ching: <br />Ed Oyarzo and Dave Sadwick of our firm recently <br />discussed with you the current status and expected activity at <br />the Cove Contractors' landfill formerly known as the California <br />Clay Landfill, located at 3242 S. E1 Dorado Street in Stockton. <br />In brief, Cove plans to accept sufficient automobile shredder <br />waste and inert material to fill the remaining volume of the <br />landfill and then to close the landfill, pursuant to waste <br />discharge requirements <br />("WDRs") to be obtained from the <br />California Regional Water Quality Control Board, Central Valley <br />Region ("Regional Board"). Cove holds a current solid waste <br />facility permit for the site allowing the acceptance of both <br />shredder waste and construction debris. This permit was issued <br />in 1979 by the San Joaquin County Public Health Services (the <br />"County") (Exhibit 5). Cove has continuously maintained this <br />permit. In addition to obtaining WDRs from the Regional Board, <br />Cove will participate in the regular review process for the <br />County permit, which is begun by the submission of a Periodic <br />Site Review report on the landfill to the County. We have met <br />with representatives of both the Regional Board and the County, <br />as well as the California Integrated Waste Management Board <br />("Waste Board"), which supervises the County, to discuss these <br />matters at length, and to schedule their completion. <br />
