California Dear Mr. Ching: Ed Oyarzo and Dave Sadwick of our firm recently discussed with you the current status and expected activity at the Cove Contractors' landfill formerly known as the California Clay Landfill, located at 3242 S. E1 Dorado Street in Stockton. In brief, Cove plans to accept sufficient automobile shredder waste and inert material to fill the remaining volume of the landfill and then to close the landfill, pursuant to waste discharge requirements ("WDRs") to be obtained from the California Regional Water Quality Control Board, Central Valley Region ("Regional Board"). Cove holds a current solid waste facility permit for the site allowing the acceptance of both shredder waste and construction debris. This permit was issued in 1979 by the San Joaquin County Public Health Services (the "County") (Exhibit 5). Cove has continuously maintained this permit. In addition to obtaining WDRs from the Regional Board, Cove will participate in the regular review process for the County permit, which is begun by the submission of a Periodic Site Review report on the landfill to the County. We have met with representatives of both the Regional Board and the County, as well as the California Integrated Waste Management Board ("Waste Board"), which supervises the County, to discuss these matters at length, and to schedule their completion.
