Mr. Robert Ching <br />February 9, 1990 <br />Page 3 <br />included required Report of Disposal Site Information <br />(11RDSI" (Exhibit 4). The RDSI states that disposal of <br />automobile demolition wastes at the site began in 1973. [,] <br />In the course of issuing the permit, the County and Waste Board <br />made several findings of fact. (Exhibit 5). These included <br />(1) a finding of fact that <br />"Operations and design [of the <br />site] immediately prior to August <br />15, 197[7] were as specified" in <br />the RDS I s ( q 1(B)) , and ( 2 ) a <br />finding of fact that "this site was <br />established before August 18, 197411 <br />(I 1(E))• Id. <br />The Waste Board's decision on the permit in 1979 specifically_ <br />found that the site was an "existing facility" and that 1973 Tomas <br />the 11 -date operations commenced., (Exhibit 6) . <br />The County permit apparently was not actually issued <br />until over two years after California Clay filed its application. <br />During this time, the site was sold to Cove Contractors, Inc., <br />the present owner. In July 1979, shortly before the <br />s <br />issued, California Clay applied to transfer the permitto Cove, <br />which transfer was approved. (Exhibit 7). <br />92nd <br />In short, these documents, which we obtained from the <br />files of the Waste Board on this site, clearly establish_ that <br />Cove's site has been operated as a landfill since 1973, four <br />years before annexation by the City. All appropriate permits and <br />governmental authorizations were obtained at the required time. <br />We therefore request your confirming letter that Cove is a "legal <br />nonconforming use," and that no discretionary permits are <br />necessary from the City for the contemplated operations above. <br />I would appreciate your direct' <br />behalf of Dove.
