Permitting and Enforcement Committee Agenda Item <br /> August 16, 1995 Page 2 <br /> facility prior to the August 16, 1995, Permitting and Enforcement <br /> Committee Meeting, at which time the LEA will submit the proposed <br /> permit. This item has been placed on the agenda because the <br /> Board has not yet delegated authority to concur in the issuance <br /> of standardized permits. If the proposed permit is not submitted <br /> in time, this item will be pulled from the agenda. <br /> Nevertheless, Board staff have reviewed the permit application, <br /> Report of Composting Site Information, and other supporting <br /> documentation and offer the following analysis : <br /> 1 . Conformance with County Plan (CCR Section 18105.1) <br /> The LEA has determined that the proposed facility is not in <br /> the most recently approved edition of San Joaquin County' s <br /> Solid Waste Management Plan (CoSWMP) . However, the County' s <br /> Local Task Force is expected to review and comment on the <br /> site identification and description prior to the committee <br /> meeting in order to satisfy the requirements of PRC <br /> 50000 (a) (4) . Once this finding is verified, the LEA can <br /> accept the permit application as complete and submit the <br /> proposed permit. <br /> 2 . Consistency with General Plan (CCR Section 18105 . 1) 0 <br /> A letter from the City of Manteca, dated, November 8, 1994, <br /> states that the proposed composting operation "would be a <br /> compatible use in an industrial or agricultural setting and <br /> would not create any adverse environmental impacts" . If the <br /> LEA agrees, the application will be accepted and this <br /> finding will be included in the proposed permit. <br /> 3 . Consistency with Waste Diversion Requirements (PRC 44009) <br /> Staff of the Board' s Governmental and Regulatory Affairs <br /> Division will make an assessment, pursuant to PRC 44009, to <br /> determine if the record contains substantial evidence that <br /> the proposed composting facility would prevent or <br /> substantially impair the achievement of waste diversion <br /> goals. Staff will present this finding at the committee <br /> meeting. <br /> 4 . California Environmental Quality Act (CEQA) <br /> State law requires the preparation and certification of an <br /> environmental document whenever a project requires <br /> discretionary approval by a public agency. The San Joaquin <br /> County Community Development Department prepared a Negative <br /> Declaration (ND) for the proposed project.
