KLE/MI-ELDER <br /> Bright People.Right Solutions. <br /> In addition, the Stockton General Plan states that, <br /> "if existing noise standards are currently exceeded, a proposed project shall not <br /> incrementally increase noise levels by more than 3 dBA." <br /> City of Stockton Development Code <br /> The City's Development Code, contained in Chapter 16 of the Municipal Code, contains <br /> detailed noise criteria that are applicable to the siting of new noise-sensitive land uses <br /> in noise-impacted areas, to infill development, and to proposed noise-generating land <br /> uses. The latter category, and the following criteria, drawn from Section 16.60.040 of <br /> the Development Code, applicable to the ESRTS project, which is a noise-generating <br /> land use. <br /> B. Standards for Proposed Noise-Generating Land-Uses and Transportation- <br /> Related Sources <br /> 2. Commercial, Industrial, and Other Land Use-Related Noise Sources <br /> (Except Infill Sites). <br /> a. New and Expanded Noise Sources. Land use-related projects that will <br /> create new noise sources or expand existing noise sources shall be <br /> required to mitigate their noise levels so that the resulting noise: <br /> i. Does not adversely impact noise-sensitive land uses; and <br /> ii. Does not exceed the standards specified in Table 3-7, Part II (see <br /> below). <br /> Noise levels shall be measured at the property line of the nearest <br /> site which is occupied by, zoned for, and/or designated on the <br /> City's General Plan Diagram to allow the development of, noise- <br /> sensitive land uses. <br /> b. Maximum Sound Level. <br /> i. Commercial. <br /> (A)The maximum sound level (Lmax) produced by commercial <br /> land uses or by other permitted noise-generating activities on <br /> any retail commercial zoning district (i.e., CO, CN, CG, CD, CL, <br /> or CA districts) shall not exceed 75 dB; and <br /> (B)The hourly equivalent sound level (Leq) from these land uses <br /> shall not exceed 65 dB during daytime or nighttime hours as <br /> 121339/ST011 R226 3-47 October 14, 2011 <br /> Copyright 2011 Kleinfelder <br />
