III. ENVIRONMENTAL SETTING,IMPACTS AND MITIGATION MEASURES <br /> A. LAND USE <br /> The zoning ordinance provides that uses within the M-2 District are permitted unless they are or <br /> may become obnoxious or offensive due to the emission of odor,dust, smoke,noise, gas, fumes, <br /> cinders, vibration,glare,refuse matter, or water-carried waste. A process to review and report on <br /> any complaint filed against a use for any of the above reasons is also provided. Where an M-2 <br /> zone abuts a residential zone,the ordinance stipulates that a six (6)foot solid masonry fence,the <br /> design of which is to be approved by the Community Development Director, shall be erected and <br /> maintained along the property line between the M-2 and residential zone when development <br /> occurs on the M-2 parcel. <br /> The project site is also within a designated Commercial and Industrial Area of the City of <br /> Stockton's Enterprise Zone, part of the California Enterprise Zone Program. The Enterprise Zone <br /> program is designed to attract and retain businesses in designated geographic areas.(City of <br /> Stockton, 1992). <br /> IMPACTS AND MITIGATION MEASURES <br /> SIGNIFICANCE CRITERIA <br /> The land use analysis presented below evaluates the consistency of the proposed project with the <br /> type and intensities of the existing and planned land uses on and surrounding the project site. <br /> According to Appendix G,Environmental Checklist,of the CEQA Guidelines(Governor's Office <br /> 1999),a project may have a significant effect on the environment if it would physically divide an <br /> established community; conflict with any applicable land use plan, policy, or regulation adopted <br /> for the purpose of avoiding or mitigating an environmental effect; or conflict with any applicable <br /> habitat conservation plan or natural community conservation plan. Potential land use conflicts or <br /> incompatibility, however, are usually the result of other environmental effects such as the <br /> generation of noise or objectionable odors. Please refer to other sections of this SEIR for more <br /> detailed discussion of these relevant environmental effects. <br /> IMPACT STATEMENTS AND MITIGATION MEASURES <br /> Impact A.1: Implementation of the proposed expansion would intensify transfer station <br /> operations in the project area,and the increased activity and proposed zoning changes <br /> could result in land use conflicts with adjacent uses. (Significant) <br /> .The non-industrial uses adjacent to the project site consist of the residences in the small R-1 <br /> district to the west, and the Trinity Community Church on Pershing Avenue adjacent to the site. <br /> The proposed use for the area west of Pershing,closest to the residences,would essentially be the <br /> continued use of the area for bin storage, although at a potentially higher level of use than under <br /> current conditions. Compared to other proposed uses of the project site,the continuation of bin <br /> storage is viewed as having a relatively low impact and would buffer residences from waste <br /> processing activities on the eastern half of the project site. Materials receiving and processing <br /> would take place east of Pershing Avenue,approximately 450 feet from the western boundary of <br /> the site.
