The San Joaquin <br /> County Community Development Department prepared a Negative <br /> Declaration (ND) , State Clearing House (SCH) #96102011, which <br /> includes an analysis of the tomato waste operations. The ND <br /> determined that those operations will not have a significant <br /> adverse effect on the environment . The document was considered <br /> and approved by the San Joaquin County Community Development <br /> Department September 4, 1996, and a Notice of Determination was <br /> filed with the County Clerk on September 4, 1996 . <br /> The LEA has determined that the ND adequately addresses the 12 .5 <br /> acre addition to the site boundaries as well as the tomato waste <br /> operations. <br /> After reviewing the environmental documentation for this project, <br /> Board staff determined that the ND addresses the tomato waste <br /> operations, which are not under the Board's jurisdiction, and <br /> that the increase in the transfer station' s permitted acreage <br /> will not change the existing facility design or operation. Any <br /> expansion of transfer station operations into the 12 .5 acre area <br /> may require additional environmental analysis. Staff have <br /> determined that the inclusion of the acreage within the site ' s <br /> permitted boundary is categorically exempt from CEQA. <br /> IV. STAFF RECOMMENDATION <br /> Because a revised Solid Waste Facility Permit has been proposed, <br /> the Board must either object to or concur with the issuance of <br /> the permit as submitted by the LEA. <br /> Staff recommend that the Board adopt Permit Decision No. 97-51 <br /> concurring with the issuance of 'Solid Waste Facility Permit No. <br /> 39-AA-0024 . <br />
