Permitting and Enforcement Committee Agenda Item
February 11, 1997 Page 3
Accept- Not To Be Not See Details
39-AA-0024 able Accept- Deter- Applic- in Agenda
able mined able Item
CIWMP Conformance(PRC 50001) X
CoSWMP Conformance(PRC 50000) X
General Plan Conformance X
(PRC 50000.5)
Conformance With State Minimum X
Standards
[California Environmental Quality Act X X
California Environmental Quality Act (CEQA)
State law requires the preparation and certification/adoption of
an environmental document whenever a project requires
discretionary approval by a public agency. The San Joaquin
County Community Development Department prepared a Negative
Declaration (ND) , State Clearing House (SCH) #96102011, which
includes an analysis of the tomato waste operations. The ND
determined that those operations will not have a significant
adverse effect on the environment . The document was considered
and approved by the San Joaquin County Community Development
Department September 4, 1996, and a Notice of Determination was
filed with the County Clerk on September 4, 1996 .
The LEA has determined that the ND adequately addresses the 12 .5
acre addition to the site boundaries as well as the tomato waste
operations.
After reviewing the environmental documentation for this project,
Board staff determined that the ND addresses the tomato waste
operations, which are not under the Board's jurisdiction, and
that the increase in the transfer station' s permitted acreage
will not change the existing facility design or operation. Any
expansion of transfer station operations into the 12 .5 acre area
may require additional environmental analysis. Staff have
determined that the inclusion of the acreage within the site ' s
permitted boundary is categorically exempt from CEQA.
IV. STAFF RECOMMENDATION
Because a revised Solid Waste Facility Permit has been proposed,
the Board must either object to or concur with the issuance of
the permit as submitted by the LEA.
Staff recommend that the Board adopt Permit Decision No. 97-51
concurring with the issuance of 'Solid Waste Facility Permit No.
39-AA-0024 .
