CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD <br /> CENTRAL VALLEY REGION <br /> RESOLUTION NO. - <br /> WAIVER OF <br /> WASTE DISCHARGE REQUIREMENTS <br /> FOR <br /> TRACY MATERIALS RECOVERY AND TRANSFER FACILITY <br /> TRACY MATERIALS RECOVERY AND SOLID WASTE TRANSFER, INC. <br /> SAN JOAQUIN COUNTY <br /> WHEREAS, Section 13260(a) of the California Water Code requires that any person <br /> discharging waste or proposing to discharge waste within the Region, other than to a <br /> community sewer, system that could affect the quality of the waters of the State, shall file a <br /> report of waste discharge; and <br /> WHEREAS, Section 13263(a) of the California Water Code requires that California <br /> Regional Water Quality Control Boards prescribe requirements as to the nature of existing and <br /> proposed discharges in their respective areas of jurisdiction; and <br /> WHEREAS, California Code of Regulations, Title 23, Division 3, Chapter 15, <br /> commencing with section 2510 contain requirements governing discharges of waste to land; <br /> and <br /> WHEREAS, the Regional Board has received a Report of Waste Discharge, dated <br /> 17 February 1994, from the Tracy Materials Recovery and Transfer Facility for a green waste <br /> composting facility; and <br /> WHEREAS, the California Integrated Waste Management Board has adopted <br /> regulations for green waste composting facilities; and <br /> WHEREAS, "green material" or "green" means any waste separated at their source of <br /> generation which are derived from plant material including but not limited to, leaves, grass <br /> clippings, weeds, tree trimmings, untreated wood waste, or shrubbery cuttings; and <br /> WHEREAS, "green composting facility" means a facility that is operated for the <br /> purpose of producing compost from the green material fraction of the waste stream: and <br /> WHEREAS, this facility is not subject to the General Industrial Storm Water Permit <br /> Program because surface water does not leave the site; and <br /> WHEREAS, green waste composting facilities that do not use any additives or <br /> amendments and that comply with the California Integrated Waste Management Board's green <br /> waste composting regulations do not pose a significant threat to ground water quality; and <br />
