Waiver of Waste Discharge Requirements -2- <br /> Tracy Materials Recovery and Transfer Facility <br /> WHEREAS, this Regional Board encourages the beneficial use of waste materials; and <br /> WHEREAS, Section 13269 of the California Water Code authorizes regional boards to <br /> waive waste discharge requirements for a specific discharge where such waiver is not against <br /> the public interest; and <br /> WHEREAS, Section 13269 of the California Water Code provides that waiver of <br /> waste discharge requirements is conditional, may be terminated for any type of discharge at <br /> any time, does not permit an illegal discharge, does not preclude the need for permits which <br /> may be required by other local or governmental agencies, and does not preclude the Regional <br /> Board from administering enforcement remedies, pursuant to Section 13304 or 13305 of the <br /> California Water Code; and <br /> WHEREAS, waiver of waste discharge requirements, where such a waiver is not <br /> against the public interest, would enable Regional Board staff resources to be used more <br /> effectively; and <br /> WHEREAS, a waiver of waste discharge requirements for the Tracy Materials <br /> Recovery and Transfer Facility would not be against the public interest because a facility that <br /> complies with the conditions of the waiver would be effectively regulated by other public <br /> agencies and would not result in violation of the Water Quality Control Plan for the Central <br /> Valley Region; and <br /> WHEREAS, San Joaquin County prepared an Environmental Impact Report for the <br /> Tracy Materials Recovery and Transfer Facility which was adopted 16 December 1993 by the <br /> San Joaquin County Planning Commission, and filed a Notice of Determination dated <br /> 30 December 1993 in compliance with Section 21152 of the Public Resources Code; and <br /> Y1HEUAS, there will be no significant adverse water quality impacts from the <br /> discharge of green waste at this facility; and <br /> WHEREAS, the Regional Board held a public hearing on 25 March 1994 in <br /> Sacramento and considered all evidence and public comments concerning this matter: <br /> Therefore, be it <br /> RESOLVED, that pursuant to Water Code Section 13269, the Regional Board hereby <br /> waives waste discharge requirements for Tracy Materials Recovery and Transfer Facility <br /> condition on: <br />
