Request for Action <br /> To: Mark de Bie,Chief <br /> Permitting and Assistance Branch <br /> Permits and Certification Division <br /> From: KevinTaylor, Section Manager <br /> Permits and Assistance Branch,North <br /> Request Date: April 13, 2011 <br /> Decision Subject: Inspection Frequency Reduction for the Martin Dairy, San Joaquin County <br /> SWIS No. 39-AA-0048 <br /> Action By: April 15,2011 <br /> This request was developed in response to the San Joaquin's County Local,Enforcement Agency's(LEA)request in a <br /> letter dated March 17,2011 (Attached)for the Department of Resources Recycling and Recovery's(Department) <br /> concurrence on a reduction in inspection frequency for the Martin Dairy, San Joaquin County, SWIS No. 39-AA-0048, <br /> pursuant to CCR Title 14, Section 18083(a). The LEA has requested to change the inspection frequency from the required <br /> quarterly to one inspection each year during the time the site is used. <br /> Background Information: <br /> The site was exempted from the requirements of a solid waste permit by the LEA on 6/22/2004,pursuant to Title 27, <br /> Section 21565 Cannery wastes are seasonally disposed at the site. <br /> The operator has agreed to contact the LEA before the first load of waste is received for disposal at the site each year, if <br /> waste is being received. The LEA will conduct at least one inspection at the beginning of the season. If land-spreading <br /> activity is occurring,the LEA will inspect once per month until the activity has ceased.An inspection report will be <br /> developed and a copy provided to CalRecycle with 30 days of the inspection date.The LEA's EPP(Enforcement Program <br /> Plan)will be updated as needed." <br /> CCR Title 14, Section 18083(a)(4)(A),states that the Department may approve an alternate inspection frequency for <br /> exempt sites if such an action will not result in adverse impact on public health and safety and the environment. It was <br /> documented in 8/2004 that there was tomato pumice on site and that it was land applied. Since 2004,the facility has not <br /> received or land applied agricultural/cannery waste. There have been no violations noted by the LEA since activities <br /> began in 2004. <br /> Recommendation: <br /> Staff recommends approval of the change to the site inspection frequency requested by the LEA. <br /> Branch Chief Action: <br /> On the basis of the information and analysis in this Request for Action,I approve the change in inspection frequency for <br /> the Martin Dairy Facility SWIS No. 39-AA-0048 to annually as requested by the LEA. <br /> Dated: <br /> Mark de Bie,Chief <br /> Permitting and Assistance Branch <br /> Permits and Certification Division <br /> CalRecycle <br /> Page 1 of 1 <br />
