Mitigation Monitoring Program(MITIGATION MONITORING AND REPORTING PROGRAM: CONSOLIDATED FORWARD LANDFILL PROJECT). The applicant and the Community Development Department shall annually review the program. Not less than 30 days nor more than 60 days prior to the first anniversary date of this approval,and each anniversary date therbafter,the applicant shall submit to the Community Development Department a letter setting forth the applicant's good faith compliance with the terms and conditions of the program. Community Development Department staff wilt visit the site semi-annually..All costs incurred by the Community Development Department for the semi-annual monitoring and the annual review shall be bome by the applicant. The costs may include costs of Community Development Department staff and administrative time and direct out-of-pocket costs and expenses, Including costs of consultants and non-department personnel. Community Development Department staff time may include overhead costs and wili be consistent with Department policy. g. MITIGATION MEASURES: The following mitigation measures identified in the Final Environmental impact Report:Consolidated Forward Landfill Project(SCH#2001052081), November 2002 are adopted as conditions of approval: N( DISE) (1) 6(C.3) Identified In EIR; (a)Heavy equipment operations shall not be conducted within 1500 feet of any occupied residence after 10 p.m. and before 6 a-m.;or (b)Equipment operations within 1500 feet of any residence after 10 p.m.or before 6 a.m. shall be fully shielded from the direct tine of sight to the residence by an earthen berm whose crown elevation exceeds the elevation of the top of the exhaust stack. (2) 7 Forward 9993(E3) The landowner and tenant at R1(reskknce at 9690 Austin'Road)shall be provlded with the option of requesting a sound wall to reduce noise exposure both in the front yard and within the home. Table fit.E.B in the Draff EJR shows the noise reduction provided by a variety of different sound wall designs The foobvtes to Table ill.E B describes the altemative designs In detail). Note that any of these desrgnrs will be more than sufficient to reduce project noise impacts below a level of significame: (3) 8 Forward 4993(E1) The contractor shall be required to arfky the quietest among alterative equipment or to muftlelcontrol noise from available equrpn'►ent. The project sponsor shall be required to demonstrate compliance with this performance standard. Work areas could be limited, work times close to the residence could be rescheduled, noise barriers such as earth berms could be designed, and noise monitoring shall be undertaken to demonstrate compliance in the event noise complaints are received.
