UNIVERSAL WASTE RULE - FLUORESCENT TUBES & OTHER LAMPS , BATTERIES , <br /> AND CATHODE RAY TUBES ( CRT) . <br /> ATHORITY . 64 Federal Register 36465 amending 40 CFR 273 <br /> DATE OF APPLICABILITY : January 6 , 2000 <br /> Generators are classified as small and large quantity generators . Small quantity generators may <br /> accumulate up to 5 , 000 kilograms ( 11 , 000 lbs . ) of all universal wastes combined (other universal <br /> wastes are waste batteries , mercury-containing switches and thermostats and banned pesticides ) . <br /> Once 5 , 000 kilograms ( 11 , 000 lbs . ) are exceeded , the generator is considered a large quantity <br /> generator. <br /> LAMPS COVERED : Any lamp which when tested exceeds the federal regulatory levels for <br /> mercury , cadmium and other hazardous waste constituents listed at 40 CFR 261 . 24 and/or 22 <br /> CCR 66261 . 24 ( a ) ( 1 ) . Fluorescent, High intensity , Neon , Mercury vapor, High -pressure sodium , <br /> and Metal halide . <br /> BATTERIES COVERED : All Alkaline , Lead Acid , Nickel Cadmium ( NiCad ) , and Lithium ( Li ) <br /> batteries . <br /> CRT' s : All CRT' s found in certain televisions , computer monitors , electronic devices , electric test <br /> equipment, and other items using CRT displays . <br /> TUBE MANAGEMENT REQUIREMENTS : As a universal waste , the covered lamps fall <br /> under the mandatory handling , storage and off-site management rules , but are not regulated as <br /> hazardous waste . <br /> 1 . Large quantity generators must notify EPA and have an EPA identification number or amend <br /> an existing number to include generation of universal wastes . Small generators are exempt <br /> from notifying EPA . <br /> 2 . Waste lamps must be placed in containers or packages that are structurally sound , adequate <br /> to prevent breakage and compatible with the contents of the lamps . The containers must <br /> remain closed and lack evidence of leakage , spillage or damage that could cause leakage . <br /> The rule does not clearly describe the container for fluorescent tubes other than to state it <br /> must be structurally sound , adequate to prevent breakage and closeable . The storage <br /> location must be inspected weekly and records kept indicating the amount and condition of <br /> the "waste" lamps being stored . <br /> 3 . Containers must be labeled " Universal Waste—Lamps" or " Waste Lamps" or " Used Lamp" . <br /> There is no requirement that the label include the date accumulation began ; however, <br /> because storage time is limited to one year and the generator must prove compliance , a date <br /> on the label is advisable . <br /> 4 . Spill or release response is required if any lamp is broken , including immediate cleanup and <br /> placing of the broken lamp in container meeting the above requirement. <br /> 5 . Employees must be trained to familiarize them with management requirements and release <br /> response procedures . <br /> 6 . Treatment by crushing is prohibited , unless a state seeks to authorize it . The state must prove <br /> the treatment method provides comparable containment of releases to the agency' s <br /> requirements . <br /> 7 . Disposal and/or dilution by mixing with other solid waste prohibited . <br /> 8 <br />
