Chronology April 16,2010
Ernie's General Store page 3
01/13/10 The EHD notified the responsible party that he was out of compliance with
regulatory directives for failing to initiate the approved SVE remediation, and
directed him to have the system in operation within 14 days or he may be
referred to the RWQCB for enforcement action.
01/22/10 AGE submitted a request on behalf of the responsible party for a deadline
extension until April 1, 2010 to have the SVE system operational. AGE stated in
the letter that they were completing "final modifications to the on-site electrical
system".
02/03/10 The EHD approved the deadline extension request, noting that no additional
deadline extensions would be granted. The responsible party was also directed
to become compliant and up to date with Geotracker submittal requirements. The
responsible party was again notified that failure to meet the deadline may result
in referral to the RWQCB for enforcement action.
03/12/10 AGE, on behalf of the responsible party, notified the EHD by email that they have
subcontracted with an electrical contractor to work on the site. This comes almost
two months after the 1/22/10 letter in which they state they were completing "final
modifications to the on-site electrical system".
04/01/10 The responsible party failed to have the SVE system in operation; he continues
to be out of compliance with regulatory directives.
