The deadline for you to take this
action was January 19, 2009. In previous EHD correspondence dated July 3, 2007 you were
notified that the deadline for implementation of the approved interim remediation was
August 20, 2007.
In Interim Soil Remediation Work Plan Addendum dated April 14, 2008 AGE proposed
modification to the type of SVE system to be used in the remediation and stated that the
system would be installed by the end of May 2008. This deadline extension was approved by
the EHD in correspondence dated April 24, 2008 but again you did not observe it. In EHD
correspondence dated August 19, 2008 you were given another opportunity to come into
regulatory compliance by having the SVE system in operation by October 24, 2008, but did
not do so. You continue to be out of compliance with regulatory directives for failing to
implement the approved interim remediation.
In order to discuss your failure to come in to compliance with regulatory directives a meeting
has been scheduled for 10 AM on February 10, 2009, and will be held at the EHD offices
located at 600 E. Main Street, Stockton, CA 95202. If this date or time are not good for you
please call Lori Duncan at(209)468-0337.
Sincerely,
Lori Duncan, REHS MargaaeLagorioAR, EHS
Registered Environmental Health Specialist Program Coordinator
c: Jim Barton, CVRWQCB, 11020 Sun Center Drive, Suite 200, Rancho Cordova CA 95670
Bill Little, AGE, 837 Shaw Road, Stockton CA 95215
