Subsequent
Quarterly Groundwater Monitoring Reports are also enclosed for your review. (See
Exhibit 1.)
In sum, remediation of hydrocarbon impacted soil and groundwater is required,
but has not yet commenced. AGI has advised me that the Corrective Action Plan will
be undergoing minor modification in the next few months. Estimates of costs to
remediate the site will not be available until the Corrective Action Plan is modified
and approved.
Underground Sto age Tank ST") Cleanup Fund Program
TFS was accepted into the UST program by the State Water Resources Control
Board (SWRCB), with the first letter of commitment issued on November 7, 1994.
The UST fund has issued approximately $18,000 in reimbursements. (See
Exhibits 2 & 3.)
Status of 102 South Wilson Way (Roek Site)
Based on the limited information available to us, it is our understanding that the
Rocks have been accepted into the UST fund. We do not know the amount of funds
reimbursed.
Remediation has not yet commenced on the property, but the Rocks are
currently in the process of receiving bids for remediation.
All documents that we have in our possession are enclosed. (See Exhibit 4.)
As I advised your investigator, other documents can be obtained from the relevant
regulatory agencies, such as the San Joaquin County Public Health Services,
Environmental Health Division ("PHS/EHD") and the SWRCB.
Based on my prior review of the Roek files from the PHS/EHD, I recollect the
following.
■ A preliminary site assessment was conducted in 1988 without regulatory
approval and oversight.
r Thereafter, an approved follow-up investigation was conducted in 1989.
