The used lead acid batteries were not labeled <br />with an accumulation start date and no bill of ladings for used lead acid batteries were available for review. To <br />maintain an exemption from managing spent lead acid batteries as hazardous waste, a generator shall not store <br />more than one ton of spent batteries at any one location for more than 180 days, store one ton or less of spent <br />batteries at any one location for more than one year, or remove the electrolyte from spent batteries. Immediately <br />comply with the storage requirements of used lead acid batteries or begin managing all used lead acid batteries as <br />hazardous waste. <br />This is a Class II violation. <br />608 <br />CCR 66266.130 Failed to properly manage used oil and fuel filters. <br />-One black metal 55 gallon drum of drained used oil filters was observed without the words "Drained Used Oil <br />Filters" and an accumulation start date. <br />-One cardboard box of drained used oil filters was observed in the hazardous waste storage area open and without <br />a label. Oil had soaked through the bottom and sides of cardboard container. <br />Used oil filters shall be drained of free-flowing oil, stored in a closed, rainproof container, labeled as "drained used oil <br />filters," and marked with an accumulation start date. Immediately label the drum and ensure that all used oil filters <br />are managed in this way. <br />Bills of lading for the recycling of used oil filters for the last three years were not found on site. A copy of each bill of <br />lading must be kept on site for at least three years. Immediately locate a copy of all bills of lading for used oil filters <br />for the last three years, maintain them on site, and submit copies to the EHD. <br />One black metal 55 gallon drum of drained used oil filters was observed without an accumulation start date. No <br />disposal records for oil filters was available for review during the inspection. Facilities that generate up to one ton of <br />used oil filters per year may store the filters up to one year. Facilities that generate one ton or more of used oil <br />filters may store the filters for up to 180 days. Immediately recycle these filters under a bill of lading and submit a <br />copy of the bill of lading to the EHD. <br />This is a repeat violation, Class ll. <br />Overall Inspection Comments: <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, by September 16, 2019. <br />Starting September 1, 2018, all in -office CERS help will be provided at EHD hourly rate ($152).
