60 CCR 66262.34(d) Stored hazardous waste onsite greater than 180 days.
One 300 gallon tank containing used oil had an accumulation start date of 10/18/2017. Facilities who generate less
than 1000 kg of hazardous waste per month and do not exceed 6000 kg of waste stored on site at any time may
store waste on site up to 180 days. Immediately contact a licensed hazardous waste hauler to dispose of this waste
under manifest and submit a copy of the manifest to the EHD.
This is a repeat violation, Class II.
Response to#601:
Maxim Oil Service was called out and pumped out 120gal of of used oil on 12/28/2018. Please see attached
manifest for the pickup. Considering how little we generate and after discussing with John,we will maintain less than
55gal onsite at any time and delivered to our main office under a BOL for documenting. It will be in turn disposed of
on our Main facilities account. Although not noted here,we did discuss our Oil Filters and they will be emptied,
punctured, and returned to Concord as well.
60 CCR 66262.34(f) Failed to completely label containers or portable tanks of hazardous waste.
One 5 gallon plastic blue bucket containing used oil (full)was observed without a hazardous label.
All hazardous waste containers shall be marked with the following information:
-the words"Hazardous Waste"
- name and address of generator
-hazardous properties
-physical state
-composition(contents)
-accumulation start date
Immediately label this container and ensure that all hazardous waste containers are marked with all the required
information.
This is a repeat violation, Class 11.
Response to#605:
This bucket was used temporarily for an oil change and was not put in the proper waste oil tank. I
discussed this with our Mechanic and informed him of proper disposal practices. This pail was emptied
into the tank prior to disposal. Pic of the pail and manifest for pickup is attached.
608 CCR 66266.130 Failed to properly manage used oil and fuel filters.
K.J Maddox stated that his mechanic takes oil filters back to a shop in Concord.
Bills of lading for the recycling of used oil filters for the last three years were not found on site. A copy of each bill of
lading must be kept on site for at least three years. Immediately locate a copy of all bills of lading for used oil filters
for the last three years, maintain them on site, and submit copies to the EHD. If there are no bills of lading for this
facility, immediately start to leave one when the mechanic transports the waste.
This is a minor violation.
Response to#608:
John and I discussed this issue at length. Unfortunately as noted earlier,we always consolidated all waste
to our main facility in Pleasant Hill (prior to 3/2018)or Concord (after 3/2018)to be disposed of. Going forward we
will abide by the following process. Used Oil Filters will be emptied, punctured, and transported to Concord
documented with a BOL. Used Oil (under 55gal)will be transported to Concord and documented with a BOL. Solid
waste will be maintained on the facility in 55gal solid waste drums and disposed of every 180 days documented with
a BOL.
Thank you,
K.JMad>
Qji*ector of Operations
Pacific States Petroleum Inc.
