SAN J 0 A Q U 1 N Environmental Health Department <br /> u ; i y 1 Iii <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> PAQ Inc DBA Food-4-Less 255 E March Ln, Stockton July 14, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 102 CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br /> OBSERVATIONS: <br /> 1.According to Wilson Nunn, Store Director,the facility employees dispose of clean-up material used to clean up <br /> spills of hard liquor in the facility, into the trash compactor without a hazardous waste determination being made. <br /> 2. The facility does not have guidance for employees on how to manage damaged, expired, or otherwise unsaleable <br /> over-the-counter pharmaceuticals(a.k.a items containing drug facts).Wilson Nunn indicated that he did not know <br /> unsaleable over-the-counter pharmaceuticals may be hazardous waste. It is unclear how the facility manages <br /> over-the-counter pharmaceutical waste. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive <br /> or ignitable. <br /> CORRECTIVE ACTION: Immediately stop disposing of hard liquor spill clean-up material into the trash, make a <br /> hazardous waste determination for hard liquor spill clean-up material and over-the-counter pharmaceutical waste, <br /> and manage them according to Title 22 CCR. Use Safety Data Sheets(SDS),waste sampling and test results or <br /> other knowledge to support your hazardous waste determination. Waste testing must be done using methods <br /> specified in Title 22 CCR including sections 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determinations. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes.
