State of California and confmed to Defendant's TRUCK REPAIR AD TRUCK WASH activities in <br />the County of San Joaquin and elsewhere in the State of California. <br />3. Defendant, with actual or constructive knowledge of this Injunction, only in so far as they <br />are doing business in the State of California, in the course of Defendant's TRUCK REPAIR AND <br />TRUCK WASH activities, are pursuant to Health and Safety Code section 25181 hereby <br />permanently enjoined from: <br />Failing to obtain and keep on file at the facility a written assessment reviewed and <br />certified by an independent, qualified, professional engineer attesting that the hazardous waste tank <br />and containment system has sufficient structural integrity, in violation of California Code of <br />Regulations, title 22 section 66265.192; <br />Failing to completely label or mark each container or portable tank used for onsite <br />accumulation of hazardous waste, in violation of California Code of Regulations, title 22 section <br />66262.34(f); <br />Treating, storing, disposing of, transporting or offering to transport hazardous <br />waste without having an Identification Number, in violation of California Code of Regulations, title <br />22 section 66262.12(a); <br />Failing to determine if that waste is a hazardous waste, in violation of California <br />Code of Regulations, title 22 section 66262.11; <br />Failing to train personnel within six (6) months after the date of their employment <br />or assignment to a facility, or to a new position at a facility, in violation of California Code of <br />Regulations, title 22 section 66265.16(b); <br />Failing to keep training records on current personnel until the closure of the facility <br />and/or on former employees for at least three (3) years from the date the employee last worked at the <br />facility, in violation of California Code of Regulations, title 22 section 66265.16(e); <br />Failing to document an inspection in the operating record of the facility, in <br />violation of California Code of Regulations, title 22 section 66265.195(c); <br />Failing to maintain and operate facility to minimize the possibility of a fire, <br />explosion, or any unplanned sudden or non-sudden release of hazardous waste, in violation of <br />- 2 - <br />PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION
