California Code of Regulations, title 22 section 66265.31; <br />Failing to keep container holding hazardous waste closed during transfer and <br />storage, except when it is necessary to add or remove waste, in violation of California Code of <br />Regulations, title 22 section 66265.173(a); <br />Failing to mark and manage an emptied container or an inner liner from a container <br />larger than five (5) gallons in capacity, in violation of California Code of Regulations, title 22 section <br />66261.7(f); <br />Failing to transfer hazardous waste in a container not in good condition to a <br />container that is in good condition, in violation of California Code of Regulations, title 22 section <br />66265.171; and <br />1. Disposing or causing the disposal of a hazardous or extremely hazardous waste at a <br />point which is not authorized, in violation of Health and Safety Code section 25189(d). <br />4. Defendant, with actual or constructive knowledge of this Injunction, only in so far as they <br />are doing business in the State of California, in the course of Defendant's TRUCK REPAIR AND <br />TRUCK WASH activities, are pursuant to Health and Safety Code section 25515.6 hereby <br />permanently enjoined from: <br />Failing to implement, maintain or to submit to the unified program agency, a <br />complete hazardous materials business plan, in violation of Health and Safety Code sections 25505 <br />and 25508, and California Code of Regulations, title 19 section 2729; <br />Failing to implement and maintain a business emergency plan for emergency <br />response to a release or threatened release of hazardous materials, in violation of Health and Safety <br />Code section 25507; and <br />Failing to implement, maintain and comply with, an employee training program, in <br />violation of Health and Safety Code section 25505(a)(4), and California Code of Regulations, title 19 <br />section 2732. <br />5. Defendant with actual or constructive knowledge of this Injunction, only in so far as they <br />are doing business in the State of California, in the course of Defendant's TRUCK REPAIR AND <br />TRUCK WASH activities, are pursuant to California Business and Professions Code, section 17204 <br />- 3 - <br />PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION
