The following is an itemized list of underground storage tank violations that have not been addressed for TOKAY SHELL as of October 07, 2020. Open violations from May 07, 2020 inspection Violation#210-No employee present that were trained in the operation and maintenance of the UST system byaDO. OBSERVATION: The designated operator employee training was not performed. REGULATION GUIDANCE: The designated operator shall train facility employees in the proper operation and maintenance of the UST system at least once every 12 months. The training shall be conducted before the individual performs the duties of a facility employees.The training shall include, but is not limited to: 1. Operation of the UST system in a manner consistent with the facility's best management practices 2. Employee's role with regard to monitoring equipment as specified in the facility's monitoring plan 3. Employee's role with regard to spills and overfills as specified in the facility's response plan 4. Name of the contact person(s)for emergencies and monitoring equipment alarms Initial training shall also include a site-specific practical demonstration that provides both sharing information and evaluating knowledge for responding to emergencies, leak detection, monitoring alarms, spills and overfills. At least one of the facility employees present during operating hours shall have current training. CORRECTIVE ACTION: Ensure that employees have been trained by the designated operator, maintain the list on site, and submit a copy of the training records to the EHD. ❑ This violation was corrected ❑This violation will be corrected by(date): ❑ Supporting documents included Describe actions taken or will be taken to correct violation: Violation#319-Failure to comply with the installation, inspection,or record keeping of the overfill prevention. OBSERVATION: The used oil tank did not have an overfill prevention system. REGULATION GUIDANCE:All underground storage tanks shall be equipped with an overfill prevention system that does not allow for manual override and meets one of the following requirements: 1. Alert the transfer operator when the tank is 90 percent full by restricting the flow into the tank or triggering an audible and visual alarm; or 2. Restrict delivery of flow to the tank at least 30 minutes before the tank overfills, provided the restriction occurs when the tank is filled to no more than 95 percent of capacity; and activate an audible alarm at least five minutes before the tank overfills; or 3. Provide positive shut-off of flow to the tank when the tank is filled to no more than 95 percent of capacity; or, 4. Provide positive shut-off of flow to the tank so that none of the fittings located on the top of the tank are exposed to product due to overfilling. CORRECTIVE ACTION: Immediately contact a properly licensed,trained, and certified contractor to install an approved overfill prevention system. Replacement of a mechanical flapper valve requires a permit and inspection by the EHD. If an external audio/visual alarm is replaced, provide a copy of the service receipt to the EHD. If an approved overfill prevention system can't be installed immediately,there is a possibility that the used oil UST system may be red tagged to prevent fuel inputs. Page 7 of 8
