Y <br /> RULE 2020 EXEMPTIONS (Adopted Septembcr 19, 1991, Amended July 16, 1992, <br /> Amended December 17, 1992, Amended October 21, 1993) <br /> 1.0 Purpose <br /> This rule specifies emissions units which are not required to obtain an Authority to <br /> Construct or Permit to Operate. This rule also specifies the recordkeeping requirements <br /> to verify the exemption and outlines the compliance schedule for emissions units that lose <br /> the exemption after installation. <br /> 2.0 Applicability <br /> This rule shall apply to any source operation which emits or may emit air contaminants. <br /> 3.0 Definitions <br /> 3.1 Emissions Unit: an identifiable process, operation, or piece of process <br /> equipment such as a source operation, which emits or may emit, or results in the <br /> emissions of any air contaminant directly or as fugitive emissions. <br /> 3.2 Existing Portable Emissions Unit: any portable emissions unit which has been <br /> located or operated in the District prior to lune 18, 1992 and after January 1, <br /> 1988. <br /> 3.3 Portable Emissions Unit: any emissions unit which is not placed on a permanent <br /> foundation and is intended to operate or provide a service at a specific location <br /> for no more than six months in any oue calendar year. For the purpose of this <br /> rule, portable emissions units shall not include tank sludge dewatering <br /> operations, asphaltic concrete plants, concrete batch plants, contaminated soil or <br /> water :remediation operations, or boilers and steam generators with a heat input <br /> rating of greater than 15 million BTUs per hour. <br /> 4.0 Emissions Units Not Requiring A Written Permit <br /> 4.1 An Authority to Construct or Permit to Operate shall not be required for any <br /> emissions unit, listed in Section 5.0, unless: <br /> 4.1.1 The emissions unit is subject to EPA 40 CFR, Part 60, New Source <br /> Performance Standards (NSPS), or EPA 40 GFR, Part 61, National <br /> Emission Standards for Hazardous Air Pollutants (NESHAPS); <br /> 4.1.2 The APCO makes a determination that a permit shall be required <br /> because the emissions unit may not operate in compliance with all <br /> District rules and regulations; <br /> .may, <br /> 51V t1APCD 2020-1 10121193 <br />
