r <br /> CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD <br /> CENTRAL VALLEY REGION <br /> CLEANUP AND ABATEMENT ORDER NO R5-2003-0713 <br />' FOR <br /> FRANK AND SHERRI GUINTA <br />' GUINTA ENTERPRISES <br /> JAMES AND MARILYN RAMSEY <br />' 2072 WEST YOSEMITE AVENUE <br /> MANTECA, SAN JOAQUIN COUNTY <br />' This Order is issued to Frank and Sherri Guinta, as husband and wife doing business as (dba) Guinta <br /> Enterprises, and James and Marilyn Ramsey, as husband and wife, hereafter collectively referred to as <br /> Dischargers based on provisions of California Water Code Section 13304, which authorizes the <br />' California Regional Water Quality Control Board, Central Valley Region (hereafter Regional Board) to <br /> issue a Cleanup and Abatement Order (Order) <br />' The Executive Officer finds, with respect to the Dischargers' acts or failure to act, the following <br />' INTRODUCTION <br /> 1 Mr William Ramsey owned the real property, including a full service fueling station, mint-market, <br /> and auto repair shop, at 2072 West Yosemite Avenue, in Manteca, San Joaquin County <br /> (Figure I) from 1977 to 1987 <br /> 2 In 1988, Leora Ramsey, the widow of William Ramsey, transferred a portion of the <br /> William Ramsey estate consisting of the real property at 2072 West Yosemite Avenue to their son <br /> and his wife, James and Marilyn Ramsey James and Marilyn Ramsey owned the full service <br /> fueling station, mini-market, and auto repair shop at the site from 1988 to 1996 <br /> James and Marilyn Ramsey are subject to this Order because they owned the property at the time <br />' the tank system caused or permitted waste to be discharged to waters of the state where it has <br /> created a condition of pollution and nuisance. <br /> 3 From 1983 to 1996, Frank Guinta leased the fueling station and mint-market from William <br /> Ramsey, and James and Manlyn Ramsey Frank and Shen Guinta, dba Guinta Enterprises, <br /> operated the fueling station continuously at the site In 1996, Frank Guinta purchased the real <br /> property at a public tax auction Frank and Sheri Guirita, as husband and wife, currently own the <br /> real property at 2072 West Yosemite Avenue, in Manteca, San Joaquin County(Site) Frank and <br />' Sherri Guinta, and Guinta Enterprises, are subject to this Order because they operated the tank <br /> system that caused or permitted waste to be discharged to waters of the state where it has created a <br /> condition of pollution and nuisance <br /> 4 From 2000 to present, the fueling station and mini-mart on the west end of the building were <br /> leased to In Sop Kim, and Myoung O Kim (Kims) The Kims now operate the gasoline dispensing <br /> system on the property and are not subject to this Order, because analysis of free phase product <br />' California Environmental Protection Agency <br /> C11 ReciCIL dPape) <br />
