CLEANUP AND ABATEMENT ORDER NO R5-2003-0713 2 <br /> FRANK and SHERRI GUINTA, dba GUINTA ENTERPRISES <br /> JAMES and MARILYN RAMSEY, <br /> I 2072 WEST YOSEMITE AVENUE <br /> MANTECA, SAN JOAQUIN COUNTY <br /> • found on-site is representative of a release that occurred pnor to 2000 There is no evidence of a <br /> release since the Kims have operated the tank system <br /> 5 From 1995 to the present, the garage on the east end of the building has been leased to Mr Dave <br /> Garza, who operates an auto repair service known as All City Auto and is not subject to the Order, <br /> because there is no evidence of a release resulting from activities at the auto repair service <br /> I <br /> FINDINGS <br />' 6 On 2 May 1992, San Joaquin County Environmental Heath Department (SJCEHD) submitted an <br />' Unauthorized Release (Leak) Report for a gasoline Ieak detected at the Site fuel dispensers during <br /> an inspection Subsequently SJCEHD discovered inconsistencies in the underground storage tanks <br /> (USTs) monthly reconciliation report of fuel supplies delivered versus sales of petroleum products, <br /> I an indicator of a leaking UST system SJCEHD directed the Dischargers to investigate the release <br /> to soil and groundwater, which included gasoline, diesel, benzene, toluene, ethylbenzene, xylenes, <br /> methyl tertiary butyl ether (MtBE), tertiary butyl alcohol, 1,2-dichloroethane (1,2-DCA), and <br /> tetrachloroethylene (PCE) (Figure 2) <br /> 7 From 1992 to 2003, SJCEHD worked with the Dischargers Work progressed slowly until <br /> 1 January 2003, at which time the Dischargers consultant turned off the SVE/AS system and <br /> declared that insufficient State Cleanup Funds remained to operate the system During a meeting <br /> at the Regional Board office on 9 April 2003, the Dischargers agreed to restart the SVE/AS system, <br /> which has now operated since May 2003 <br /> S In September 2000, 12 domestic wells were subsequently discovered as impacted by MtBE or <br />' 1,2-DCA and disconnected from the residences (Figure 3) Temporary bulk water supply tanks <br /> were installed at each home and water delivery was initiated by the Dischargers <br /> 9 SJCEHD staff met with City of Manteca Public Works (City of Manteca) to discuss installation of <br /> a public water supply and sanitary sewer line for the City of Manteca and unincorporated area <br /> residents impacted by MtBE and 1,2-DCA plumes Connections to the City of Manteca utilities <br />' were not feasible at that time due to estimated cost (52,000,000) and length of time (two years) for <br /> annexation of the unincorporated area <br />' 10 By January 2002, 12 wellhead treatment systems were installed to protect public health at <br /> residences with impacted wells <br /> 11 The Site was referred by SJCEHD to the Regional Board for non-compliance with the <br /> 25 February 2003 SJCEHD directive to restart the remedial systems This Regional Board Order <br /> to cleanup and abate the wastes (Order) is necessary because water quality, human health, and <br /> safety are impacted, pnvate wellhead treatment and remedial systems need to be operated and <br /> maintained without interruption, and groundwater cleanup is not complete In issuing this Order, <br /> lead regulatory oversight is transferred from San Joaquin County to the Regional Board <br />
