WASTE DISCHARGE REQUIREMENTS <br /> CITY OF MANTECA <br /> SAN JOAQUIN COUNTY -6- <br /> 3. The Discharger shall comply with all the items of the "Standard Provisions <br /> and Reporting Requirements (NPDES)", dated 1 August 1984, which are part <br /> of this Order. <br /> 4. The Discharger shall comply with all pretreatment requirements contained <br /> in 40 CFR, Part 403, and shall be subject to enforcement actions, penal- <br /> ties, fines and other remedies by EPA or other appropriate parties, as <br /> provided in the Clean Water Act, as amended. The Discharger shall imple- <br /> ment and enforce its approved Publicly-Owned Treatment Works (POTW) <br /> Pretreatment Program which is hereby made an enforceable condition of <br /> these requirements. EPA may initiate enforcement action against an <br /> industrial user for noncompliance with applicable standards and require- <br /> ments as provided in the Clean Water Act. <br /> 5. The Discharger shall enforce the requirements promulgated under Sections <br /> 307(b) , (c) , (d), and 402(b) of the Clean Water Act. The Discharger shall <br /> cause industrial users subject to federal categorical standards to achieve <br /> compliance no later than the date specified in those requirements or, in <br /> the case of a new industrial user, upon commencement of the discharge. <br /> 6. The Discharger shall perform the pretreatment functions as required in 40 <br /> CFR Part 403 including, but not limited to: <br /> a. Implement the necessary legal authorities as provided in 40 CFR <br /> 403.8(1) ; <br /> b. Enforce the pretreatment requirements under 40 CFR 403.5 and 403.6; <br /> c. Implement the programmatic functions as provided in 40 CFR 403.8(f) <br /> (2) ; and <br /> d. Provide the requisite funding and personnel to implement the pretreat- <br /> ment program as provided in 40 CFR 403.8(f) (3) . <br /> 7. The Discharger shall submit annually a report to EPA and the Board de- <br /> scribing the Discharger's pretreatment activities over the previous 12 <br /> months. In the event that the Discharger is not in compliance with any <br /> conditions or requirements of this permit, the Discharger shall include <br /> the reasons for noncompliance and state how and when the Discharger shall <br /> comply with such conditions and requirements. This annual report is due <br /> on 31 January of each year and shall contain, but not be limited to, the <br /> items listed in Section F of the Special Provisions and Reporting Require- <br /> ments (NPDES) . <br />
