The Discharger shall comply with all the items of the "Standard Provisions and Reporting Requirements (NPDES)", dated 1 August 1984, which are part of this Order. 4. The Discharger shall comply with all pretreatment requirements contained in 40 CFR, Part 403, and shall be subject to enforcement actions, penal- ties, fines and other remedies by EPA or other appropriate parties, as provided in the Clean Water Act, as amended. The Discharger shall imple- ment and enforce its approved Publicly-Owned Treatment Works (POTW) Pretreatment Program which is hereby made an enforceable condition of these requirements. EPA may initiate enforcement action against an industrial user for noncompliance with applicable standards and require- ments as provided in the Clean Water Act. 5. The Discharger shall enforce the requirements promulgated under Sections 307(b) , (c) , (d), and 402(b) of the Clean Water Act. The Discharger shall cause industrial users subject to federal categorical standards to achieve compliance no later than the date specified in those requirements or, in the case of a new industrial user, upon commencement of the discharge. 6. The Discharger shall perform the pretreatment functions as required in 40 CFR Part 403 including, but not limited to: a. Implement the necessary legal authorities as provided in 40 CFR 403.8(1) ; b. Enforce the pretreatment requirements under 40 CFR 403.5 and 403.6; c. Implement the programmatic functions as provided in 40 CFR 403.8(f) (2) ; and d. Provide the requisite funding and personnel to implement the pretreat- ment program as provided in 40 CFR 403.8(f) (3) . 7. The Discharger shall submit annually a report to EPA and the Board de- scribing the Discharger's pretreatment activities over the previous 12 months. In the event that the Discharger is not in compliance with any conditions or requirements of this permit, the Discharger shall include the reasons for noncompliance and state how and when the Discharger shall comply with such conditions and requirements. This annual report is due on 31 January of each year and shall contain, but not be limited to, the items listed in Section F of the Special Provisions and Reporting Require- ments (NPDES) .
