REVISED WASTE DISCHARGE REQUIREMENTS ORDER NO. 97-115 7 <br /> CITY OF MANTECA AND CITY OF LATHROP <br /> WASTEWATER QUALITY CONTROL FACILITY <br /> SAN JOAQUIN COUNTY <br /> 39. The action to renew an NPDES permit is exempt from the provisions of Chapter 3 of the <br /> California Environmental Quality Act(CEQA) (Public Resources Code Section 21100, et seq.), <br /> in accordance with Section 13389 of the California Water Code. <br /> 40. The Board has notified the Discharger and interested agencies and persons of its intent to prescribe <br /> waste discharge requirements for this discharge and has provided them with an opportunity for a <br /> public hearing and an opportunity to submit their written views and recommendations. <br /> 41. The Board, in a public meeting, heard and considered all comments pertaining to the discharge. <br /> 42. This Order shall serve as an NPDES permit pursuant to Section 402 of the CWA, and <br /> amendments thereto, and shall take effect upon the date of hearing, provided EPA has no <br /> objections. <br /> IT IS HEREBY ORDERED that Order No. 97-115 is revised and the City of Manteca and City of <br /> Lathrop, its agents, successors and assigns, in order to meet the provisions contained in Division 7 of the <br /> California Water Code and regulations adopted hereunder, and the provisions of the Clean Water Act <br /> and regulations and guidelines adopted hereunder, shall comply with the following: <br /> A. Discharge Prohibitions: <br /> 1. Discharge of treated wastewater at a location or in a manner different from that described in <br /> Finding No.2 is prohibited. <br /> 2. The by-pass or overflow of wastes to surface waters is prohibited, except as allowed by <br /> Standard Provision A. 13. <br /> 3. The discharge of wastewater to the San Joaquin River when the velocity of the river through <br /> the cross sectional at the discharge point is less than 0.56 ft/sec from 1 June to 30 September <br /> and 0.69 ft/sec from 1 October to 31 May is prohibited. <br /> B. Effluent Limitations: (Discharge to land): <br /> 1. The City of Manteca proposes to continue the use of wastewater irrigation for Fodder, Fiber, <br /> and Seed Crops. Title 22, Division 4, California Code of Regulations, Section 60309 <br /> requires a level of wastewater quality applied for non-food crops to be no less than that of <br /> primary effluent. <br /> If, in the future, the City chooses to irrigate food crops with wastewater, a higher level of <br /> treatment will be necessary as outlined in Title 22. <br /> 2. The Discharger shall maximize disposal of effluent to land at agronomic rates at all times. <br /> 3. The dissolved oxygen content of holding ponds shall not fall below 1.0 mg/l. <br />
