At the Sacramento Facility, the Policies are used to <br /> determine at that time whether, among other things, (i) a returned product is <br /> resalable; (ii) a returned product is damaged or considered a waste; and (iii) any <br /> credit should be provided to the customer. <br /> b) Who transports the damaged product to this location? <br /> During the normal course of the reverse-distribution process, third-party <br /> transporters transport to the Stockton Facility the returned products for which <br /> customers seek credit. At the time the third-party transporters transport the <br /> returned products to the Stockton Facility, the returned products are not <br /> considered to have been damaged. <br /> c) Do vendors transport damaged product to this location? <br /> No vendors transport to the Stockton Facility any returned product. <br /> d) Which vendors? N/A <br /> e) What are the sources of the damaged products including addresses and <br /> company names? <br /> The companies object to the request on the following grounds (i)the request is <br /> overly broad and burdensome as it is unlimited in time; (ii) the request seeks <br /> information which is proprietary and constitutes a trade secret; (iii) the request <br /> seeks information which is not relevant and not reasonably related to the <br /> purported violations; and (iv) the request exceeds the scope of Health and Safety <br /> Code section 25185.6. Without waiving the foregoing objections, the companies <br /> responds as follows: the existing information in the possession of the companies <br /> does not correlate any specific returned product which has been found to have <br /> been damaged to a specific customer. <br /> 5. Three part question: <br /> a) When damaged products are received at this facility where are they stored? <br /> Products that have been returned by the companies' customers and received at <br /> the Stockton Facility are not considered damaged products.
