4 . Indy shall comply with article 6, chapter 20 of Title <br /> 22, division 4.5, CCR commencing with section 66270.60, <br /> and comply with all regulations regarding fixed <br /> treatment units, chapter 45 of Title 22 , division 4 .5, <br /> CCR commencing with section 67450. 1. <br /> Any hazardous waste generated by Indy shall be managed <br /> in accordance with all applicable federal, state, and <br /> local agency requirements. <br /> 5. No releases shall be made to the air, land, and, or <br /> water. All operations shall be conducted to minimize <br /> potential harm to operators, transporters, and the <br /> environment. <br /> 6. The diversion of the wastewater generated at Olin back <br /> to Indy's unit for treatment shall be conducted as <br /> described in the application packet submitted to this <br /> Department, and in accordance with the procedures and <br /> conditions contained in this variance determination. <br /> 7 . This Department shall be notified immediately upon <br /> discovery of any situation not addressed in the <br /> aforementioned documents. <br /> 8. This variance applies only to the hazardous waste <br /> facility permitting requirements of Health and Safety <br /> Code, section 25201 and division 4 . 5, chapter 20 and <br /> chapter 45, Title 22 , CCR, and may be amended or <br /> revoked by the Department at any time. A copy of this <br /> variance shall be kept at the treatment units site at <br /> all times and must be available for inspection by the <br /> Department or its designee. <br /> 9. Nothing in this variance shall be construed to limit <br /> the authority of the Department to enter and inspect <br /> Indy's facility for purposes of evaluating compliance <br /> with the requirements of this variance, and to take any <br /> enforcement action in connection with this variance. <br /> Nothing herein shall be construed to relieve Indy of <br /> its obligation to perform any remedial or corrective <br /> action pursuant to chapter 6. 5 or 6.8 of the HSC, or to <br /> limit, abridge, or otherwise supersede the authority of <br /> any federal, state or local governmental agency. <br /> 10. This variance is subject to review at the discretion of <br /> the Department, and may be modified or revoked at any <br /> time the conditions, limitations, or other requirements <br /> or this variance are no longer satisfied. <br /> 4 <br />
