The 87 and diesel spill containers failed to have a minimum capacity of five gallons. All spill containers shall have a minimum capacity of five gallons. Immediately contact a properly licensed, trained, and certified contractor to repair or replace the spill containers under permit and inspection of the EHD. The 87 direct-bury spill container failed when tested. The technician chose not to test either spill container after they both failed to hold 5 gallons. In the few minutes between adding the initial water in the spill bucket and returning to vacuum the water out, the liquid in the 87 spill container dropped approximately 1 inch. All spill containers shall have a minimum capacity of five gallons and be capable of containing a spill or overfill until it is detected or cleaned up. Immediately discontinue deposition of petroleum into this tank until the component is repaired or replaced by a properly licensed, trained, and certified contractor under permit and inspection of the EHD. If the spill container can't be replaced immediately, there is a possibility that the 87 UST system may be red tagged to prevent fuel inputs. This is a minor violation. 320 CCR 2635, 2637.2, 2665, 2712 Failure to comply with the installation, inspection, or record keeping of the overfill prevention. The 87 and diesel mechanical flappers used as the overfill prevention system were marked as failures on the 10/11/18 Overfill Prevention Equipment Inspection Report. Immediately discontinue deposition of petroleum into this tank until the component is repaired or replaced by a properly licensed, trained, and certified contractor under permit and inspection of the EHD. If the failed component can't be replaced immediately, there is a possibility that the 87 and diesel UST systems may be red tagged to prevent fuel inputs. This is a Class II violation. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by February 24, 2019.
