SAN JOAQUIN <br /> Environmental Health Department <br />Small Quantity Hazardous Waste Generator Inspection Report <br />Facility Name: <br />DELGADO AUTO REPAIR <br />Facility Address: <br />101 W DR MARTIN LUTHER KING JR BLVD, <br />Date: <br />December 06, 2019 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />Item # Remarks <br />1 0 1 CCR 66262.12 Managed a hazardous waste without an identification number. <br />OBSERVATION: This business does not have a hazardous waste ID number in the California Department of Toxic <br />Substances Control (DTSC) database. <br />REGULATION GUIDANCE: A hazardous waste generator shall not treat, store, dispose of, transport or offer for <br />transportation, hazardous waste without having received an Environmental Protection Agency (EPA) Identification <br />(ID) Number. A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per <br />month, less than one kg of acutely hazardous waste per month or any amount of non-RCRA hazardous waste. ID <br />numbers are unique to a business and site location. <br />CORRECTIVE ACTION: Go to the DTSC web site at https://dtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/ <br />to obtain a State ID number. Immediately apply for your ID number and submit evidence to the San Joaquin County <br />Environmental Health Department within 30 days. <br />This is a Class II violation. <br />102 CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br />OBSERVATIONS: Oily absorbent and rags are thrown away into the trash. <br />REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br />as specified in Title 22 California Code of Regulations (CCR). There are wastes that are listed as hazardous <br />wastes. There are wastes that exhibit one or more of the hazardous waste characteristics: toxic, corrosive, reactive <br />or ignitable. <br />CORRECTIVE ACTION: Immediately cease disposal of oily absorbent and rags into the trash. Make a hazardous <br />waste determination for each waste and manage them according to Title 22 CCR. Use Safety Data Sheets (SDS), <br />waste sampling and test results or other knowledge to support your hazardous waste determination. Waste testing <br />must be done using methods specified in Title 22 CCR including sections 66261.20-24. <br />Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br />storage and labeling for wastes determined to be hazardous wastes.
