Date: December 06, 2019 SUMMARY OF VIOLATIONS (CLASS I, CLASS II, or MINOR - Notice to Comply) Item # Remarks 201 HSC 25163(a) Transported or transferred hazardous waste to a transporter without valid registration. OBSERVATION: This business transferred hazardous waste to a transporter without a valid hazardous waste transporter registration. Ariel Canales, Owner, stated that he gives his unpunctured/uncrushed metal oil filters back to the customer. He is not sure what happens to the filters after they take them. VIOLATION GUIDANCE: Except as otherwise provided, it is unlawful for any person to carry on, or engage in, the transportation of hazardous wastes unless the person holds a valid registration issued by the department, and it is unlawful for any person to transfer custody of a hazardous waste to a transporter who does not hold a valid registration issued by the department. A person who holds a valid registration issued by the department pursuant to this section is a registered hazardous waste transporter for purposes of this chapter. Any registration issued by the department to a transporter of hazardous waste is not transferable from the person to whom it was issued to any other person. Any person who transports hazardous waste in a vehicle shall have a valid registration issued by the department in his or her possession while transporting the hazardous waste. The registration certificate shall be shown upon demand to any representative of the department, officer of the Department of the California Highway Patrol, any local health officer, or any public officer designated by the department. CORRECTIVE ACTION: The violation was corrected during the inspection. Ariel Canales stated that he would no longer give filters back to his customers. No further action is required to correct this violation. This is a Class I violation. 303 CCR 66262.34(d)(2) Failed to maintain all communication or alarm systems, spill control, or decontamination equipment. OBSERVATION: The used oil secondary containment had used oil in it. REGULATION GUIDANCE: All facility communications or alarm systems, fire protection equipment, spill control equipment, and decontamination equipment, where required, shall be tested and maintained as necessary to assure its proper operation in time of emergency. CORRECTIVE ACTION: Bring the secondary containment into proper working order by repair, replacement or testing. Provide a corrective action statement to the San Joaquin County Environmental Health Department within 30 days. This is a Class II violation.
