SAN JOAQUIN <br /> <br />Environmental Health Department <br />Small Quantity Hazardous Waste Generator Inspection Report <br />Facility Name: <br />DELGADO AUTO REPAIR <br />Facility Address: <br />101 W DR MARTIN LUTHER KING JR BLVD. <br />Date: <br />December 06, 2019 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />Item # Remarks <br />201 HSC 25163(a) Transported or transferred hazardous waste to a transporter without valid registration. <br />OBSERVATION: This business transferred hazardous waste to a transporter without a valid hazardous waste <br />transporter registration. Ariel Canales, Owner, stated that he gives his unpunctured/uncrushed metal oil filters back <br />to the customer. He is not sure what happens to the filters after they take them. <br />VIOLATION GUIDANCE: <br />Except as otherwise provided, it is unlawful for any person to carry on, or engage in, the transportation of hazardous <br />wastes unless the person holds a valid registration issued by the department, and it is unlawful for any person to <br />transfer custody of a hazardous waste to a transporter who does not hold a valid registration issued by the <br />department. A person who holds a valid registration issued by the department pursuant to this section is a <br />registered hazardous waste transporter for purposes of this chapter. Any registration issued by the department to a <br />transporter of hazardous waste is not transferable from the person to whom it was issued to any other person. <br />Any person who transports hazardous waste in a vehicle shall have a valid registration issued by the department in <br />his or her possession while transporting the hazardous waste. The registration certificate shall be shown upon <br />demand to any representative of the department, officer of the Department of the California Highway Patrol, any <br />local health officer, or any public officer designated by the department. <br />CORRECTIVE ACTION: The violation was corrected during the inspection. Ariel Canales stated that he would no <br />longer give filters back to his customers. No further action is required to correct this violation. <br />This is a Class I violation. <br />303 CCR 66262.34(d)(2) Failed to maintain all communication or alarm systems, spill control, or decontamination <br />equipment. <br />OBSERVATION: The used oil secondary containment had used oil in it. <br />REGULATION GUIDANCE: All facility communications or alarm systems, fire protection equipment, spill control <br />equipment, and decontamination equipment, where required, shall be tested and maintained as necessary to assure <br />its proper operation in time of emergency. <br />CORRECTIVE ACTION: Bring the secondary containment into proper working order by repair, replacement or <br />testing.
