The Board at its discretion may waive the re- <br /> quirements of this Chapter for solid waste disposal sites for such reasons <br /> ;is size, duration of operation, purpose, types of wastes to be disposed <br /> of, and emergency situations. <br /> 17904. Noncompliance. If a city or county or the Board find< a <br /> facility has commenced operation after August 28, 1974 and the Board <br /> has not made a determination of findings in accordance with Section <br /> 17931 and Section 17938 of this Chapter, the facility o%vner and or <br /> operator shall be required to file a notice of intent or notification of <br /> proposed facilities as required in Section 17926 or Section 17936. Failure <br /> to file a notification as required by this Section within fifteen (15) da%s <br /> of notice by a city;county, or the Board may result in action through <br /> the Attorney General's Office. <br /> 17905. Violations. The Board shall after notification, at a public <br /> hearing, make a finding of public health, need and necessity. or the <br /> Board, a county or a city, may bring action to terminate operation of <br /> a facility which was placed into operation in violation of the require- <br /> ments of this Chapter. <br />
