The regulations contained herein are pre- <br /> scribed by the State Solid Waste ianagement Boardpursuant to au- <br /> thority granted in Government Code Section 66783.1 and 66784 to <br /> determine the need of a new solid waste transfer station or disposal site <br /> in counties .where a solid waste management plan has not been ap- <br /> proyed by the Board and to assure that all),new solid waste facilities owill <br /> be in conformance with the solid waste management plan where such <br /> flans have been approved by the Board. <br /> NOTE: Authoritt cited: Sections 667831 and 66784, Government Code. Reference <br /> 1ections 667911 and 66784,Government Code <br /> llioorl: 1. Ne" Chapter 4 (Articles 1-4.Sections 17900-17939,not consecutive) filed <br /> 6-5-75:effective thirtieth day thereafter (Register 75, No,231 <br /> 17901. Scope. These regulations are intended to stipulate the <br /> manner in which the Board will determine (1) the necessity of the <br /> immediate implementation of a facility because of protection of the <br /> public health or because of public need or, (2) if a facility is in conform- <br /> ance with the county solid waste management plan. <br /> 17902. Applicability. The regulations of this Chapter are to be <br /> followed by any person before commencing the following actions: <br /> (a) Operation of a new solid waste transfer station or disposal site <br /> prior to the approval of the county solid waste management plan by the <br /> Board, and <br /> (b) Establishment or operation of a new solid waste disposal site, <br /> transfer station,waste processing or resource recovery facility after the <br /> cotinty solid waste management plan has been approved by the Board. <br /> 17902.1. Exemptions from Requirement of a Finding of Need and <br /> "'ecessity or a Determination of Conformance. <br /> The boa:d exempts the following specific classifications of solid waste <br /> facilities from the requirements of sections 66783.1 and 66784 of the <br /> Covernment Code. <br /> (a) Facilities or portions thereof, established for research purposes <br /> only, funded primarily by government grants; <br /> (b) Drilling mud disposal sites for short-term use (less than one <br /> year, on a one time use per site basis where significant quantities of <br /> hazardous or toxic materials are not present in the mud, fluids or cut- <br /> tings from drilling and associated operations and if the sites have cur- <br /> rently valid Waste Discharge Requirements from a California Regional <br /> Mater Quality Board, <br /> (c) Farm or ranch disposal sites for one or two family use; <br /> (d) Resource recovery facilities intended only for demonstration <br /> purposes not to exceed two years, not operated for profit, and not <br /> accepting significant quantities of waste; <br /> (e) Small volume transfer stations of less than 15 cubic yards of <br /> combined container volume with a maximum through-put 15 cubic <br /> yards per day. <br /> (f) industrial disposal sites located on the producer's property to be <br /> used for the exclusive disposal of insignificant quantities of the owner's <br /> wastes.These wastes must be non-hazardous and their disposal shall not <br /> pose a threat to the public health, safety, or the environment. <br />
