Based on the types of violations observed,the facility employees are not trained on proper hazardous waste(HW) handling or the training provided has been inadequate. The following observations were made in the store's back storage room at the time of inspection: -An aerosol can of Professional Sebastian Dry Clean Only dry shampoo, labeled as flammable,was found in a Toxic&State Regulated (State Toxic) HW tote(IMG 3307-3309).Although, according to the Sally Beauty Holding's, Inc. Hazardous Material Management Poster(The Poster), aerosol metal cans including dry shampoo shall be placed in the Flammable Gases, Liquids&Solids(Flammables)HW tote(IMG 3342). Samantha Mustain, store manager, placed the item into the Flammables HW tote at the time of inspection. -A tube of Color Intensity Semi-Permanent Clear Mixer creme hair color was found in the Corrosive Bases HW tote (IMG 3310, 3311, 3315).Although, according to The Poster, semi-permanent hair color shall be placed in the State Toxic HW tote. Samantha placed the item into the State Toxic HW tote at the time of inspection. -A tube of Aquage illuminating gelade, labeled as"Combustible,"was found in a State Toxic HW tote(IMG 3322, 3324-3327).Although, according to the HW tote labeled as Aerosols, Flammables, &Combustibles(Flammables), combustibles shall be placed in the Flammables HW tote. Samantha placed the item into the Flammables HW tote at the time of inspection. -Two bottles of Paul Mitchell Super Skinny Serum, labeled as"Flammable liquid,"was found in a State Toxic HW tote(IMG 3322, 3328-3332).Although, according to the label on the Flammables HW tote and The Poster, flammable liquids shall be placed in the Flammables HW tote. Samantha placed the items into the Flammables HW tote at the time of inspection. -Five boxes of Bosley Professional Strength Hair Thickening Fibers were found in a State Toxic HW tote (IMG 3322, 3336-3339). None of the HW tote labels, nor The Poster, included hair thickening fibers or a similar type of item. The SDS for this item stated the product is flammable(IMG 3340-3341). Samantha placed the items into the Flammables HW tote at the time of inspection. -Each misplaced item listed above was found in a bag containing an item(s)of a different waste categorization/type. According to the Sally Beauty Holdings, Inc. Guidelines For Accumulating Hazardous Waste poster, and the Hazardous Waste Training Guide, only one waste type/item shall be placed in any one bag (IMG 3344, 3347). -According to Samantha, she has not watched the (California) How To Categorize Products video on the Athena application on the store's Ipad, however some of the other employees have watched the video(IMG 3355-3356). According to Samantha,the Employee Hazardous Waste Training Log (IMG 3346), indicates which employees viewed the Sally's Beauty Holdings, Inc. Hazardous Waste Training DVD in 2018 (IMG 3352). There was no employee training log on site indicating which employees have watched the Store Hazardous Waste Training and (California)How To Categorize Products videos found on the Athena application. The generator must ensure that all employees who handle hazardous waste are thoroughly familiar with proper waste handling and emergency procedures. Provide proof of training and training materials to the EHD for employees whose responsibilities include hazardous waste. This is a Class II violation.
