OBSERVATION: A copy of the contingency plan was not observed on-site during the inspection. REGULATION GUIDANCE: A copy of the contingency plan and all revisions to the plan shall be: (a) maintained at the facility; and (b) submitted to all local police departments, fire departments, hospitals, and State and local emergency response teams that may be called upon to provide emergency services. CORRECTIVE ACTION: Maintain a copy of the contingency plan on-site and submit to all required local agencies. Provide a corrective action statement and supporting documentation to the San Joaquin County Environmental Health Department (EHD) within 30 days. This is a minor violation. 114 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. OBSERVATION: Designated facility signed copies of Uniform Hazardous Waste Manifest (UHWM) numbers 019743241JJK from 1/2/19 and 018964971JJK from 6/20/19 were not found on-site. REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance with section 66262.23(a) for three years or until the generator receives a signed copy from the designated facility which received the waste. This signed copy shall be retained as a record for at least three years from the date the waste was accepted by the initial transporter. The hazardous waste generator must submit an exception report to the California Department of Toxic Substances Control (DTSC) within 45 days if the destination facility signed manifest copy is not received from the transporter or designated facility. CORRECTIVE ACTION: Locate a copy of the destination facility signed manifests and send a copy to the San Joaquin County Environmental Health Department (EHD). If the destination facility signed manifests cannot be found then prepare an exception report for each missing manifest as required by Title 22 California Code of Regulations section 66262.42.
