Environmental Health Department Small Quantity Hazardous Waste Generator Inspection Report Date: November 07, 2019 Facility Address: 5406 Pacific Ave, Stockton Facility Name: Petco #1319 SUMMARY OF VIOLATIONS (CLASS I, CLASS II, or MINOR - Notice to Comply) RemarksItem # 109 CCR 66262.23(a)(4) Failed to send generator manifest copies to DTSC within 30 days. OBSERVATION: Generator copies of Uniform Hazardous Waste Manifests (UHWM) from 6/30/2018 through 11/7/2019 were not sent to the California Department of Toxic Substances Control (DTSC) within 30 days of hazardous waste shipment. According to Jackie McKenzie, Merchandise Operations Leader, who is in charge of the facility's hazardous waste area, the facility keeps manifests received from the hazardous waste hauler in a binder in the hazardous waste storage area, and does not send copies of the manifests anywhere. REGULATION GUIDANCE: Hazardous waste generators are required to send a copy of the generator signed UHWM to DTSC by mail. The only exception is when an UHWM starts and finishes as an electronic manifest in the e-Manifest System. The generator shall within 30 days of each shipment of hazardous waste submit to DTSC a legible copy of each manifest used. The mailing address is: DTSC Generator Manifests, Department of Toxic Substances Control, P.O. Box 400, Sacramento, CA 95812-0400. CORRECTIVE ACTION: Immediately mail a copy of the UHWMs from 6/30/2018 through 11/7/2019 and ensure that copies of all generator signed UHWMs are sent to DTSC within 30 days of shipping the hazardous waste. Also provide a corrective action statement and supporting documentation to the San Joaquin County Environmental Health Department (EHD). This is a Class II violation. 110 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. OBSERVATION: Designated facility signed copies of the following Uniform Hazardous Waste Manifest (UHWM) numbers were not found on-site: - 008631923FLE (11/29/2016) (see photo IMG 9351) - 005888087FLE (4/18/2018) (IMG 9350) - 005888121FLE (4/30/3018) (IMG 9326) - 011385160FLE (10/16/2018) (IMG 9321) REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance with section 66262.23(a) for three years or until the generator receives a signed copy from the designated facility which received the waste. This signed copy shall be retained as a record for at least three years from the date the waste was accepted by the initial transporter. The hazardous waste generator must submit a copy of the manifest to the California Department of Toxic Substances Control (DTSC) within 60 days if the destination facility signed manifest copy is not received from the transporter or designated facility. CORRECTIVE ACTION: Locate a copy of the destination facility signed manifests, listed above, and send a copy to the San Joaquin County Environmental Health Department (EHD). If the destination facility signed manifests cannot be found then send to DTSC a copy of each generator signed manifest and a statement that the designated facility signed copy was not received by the generator.
