Environmental Health Department <br />Small Quantity Hazardous Waste Generator Inspection Report <br />Date: <br />November 07, 2019 <br /> Facility Address: <br /> 5406 Pacific Ave, Stockton <br /> Facility Name: <br /> Petco #1319 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 109 CCR 66262.23(a)(4) Failed to send generator manifest copies to DTSC within 30 days. <br />OBSERVATION: Generator copies of Uniform Hazardous Waste Manifests (UHWM) from 6/30/2018 through <br />11/7/2019 were not sent to the California Department of Toxic Substances Control (DTSC) within 30 days of <br />hazardous waste shipment. According to Jackie McKenzie, Merchandise Operations Leader, who is in charge of <br />the facility's hazardous waste area, the facility keeps manifests received from the hazardous waste hauler in a <br />binder in the hazardous waste storage area, and does not send copies of the manifests anywhere. <br />REGULATION GUIDANCE: Hazardous waste generators are required to send a copy of the generator signed <br />UHWM to DTSC by mail. The only exception is when an UHWM starts and finishes as an electronic manifest in the <br />e-Manifest System. The generator shall within 30 days of each shipment of hazardous waste submit to DTSC a <br />legible copy of each manifest used. The mailing address is: DTSC Generator Manifests, Department of Toxic <br />Substances Control, P.O. Box 400, Sacramento, CA 95812-0400. <br />CORRECTIVE ACTION: Immediately mail a copy of the UHWMs from 6/30/2018 through 11/7/2019 and ensure <br />that copies of all generator signed UHWMs are sent to DTSC within 30 days of shipping the hazardous waste. <br />Also provide a corrective action statement and supporting documentation to the San Joaquin County <br />Environmental Health Department (EHD). <br />This is a Class II violation. <br /> 110 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. <br />OBSERVATION: Designated facility signed copies of the following Uniform Hazardous Waste Manifest (UHWM) <br />numbers were not found on-site: <br />- 008631923FLE (11/29/2016) (see photo IMG 9351) <br />- 005888087FLE (4/18/2018) (IMG 9350) <br />- 005888121FLE (4/30/3018) (IMG 9326) <br />- 011385160FLE (10/16/2018) (IMG 9321) <br />REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in <br />accordance with section 66262.23(a) for three years or until the generator receives a signed copy from the <br />designated facility which received the waste. This signed copy shall be retained as a record for at least three years <br />from the date the waste was accepted by the initial transporter. The hazardous waste generator must submit a <br />copy of the manifest to the California Department of Toxic Substances Control (DTSC) within 60 days if the <br />destination facility signed manifest copy is not received from the transporter or designated facility. <br />CORRECTIVE ACTION: Locate a copy of the destination facility signed manifests, listed above, and send a copy <br />to the San Joaquin County Environmental Health Department (EHD). If the destination facility signed manifests <br />cannot be found then send to DTSC a copy of each generator signed manifest and a statement that the designated <br />facility signed copy was not received by the generator. DTSC address is DTSC Report Repository, Generator <br />Information Services Section, PO Box 806, Sacramento, CA 95812-0806.
