I note that that Ashley is envisioned to have a 50' right of way (currently 40'), but the development is being required to dedicate 5' of right of way. This means to obtain a 50' right of way 5' to the north side of Ashley will need to be obtained by eminent domain from numerous parcels that lie on the north side, where established fencing trees, vegetation and power lines are. This will be a lengthy costly endeavor for the county, one that can be avoided, without any burden to the proposal, by making the subdivision contingent on dedication of 10' of right of way. The staff report at page 7 speaks of drainage ditch-is this located on the parcels or in the right of way.-this not clear? Is a ditch required in parcels 1 and 2?Who is liable for incidents stemming from the ditches and for their maintenance? Second, given that access for parcels 1 and 2 are, per earlier correspondence, apparently is envisioned to be directly onto Ashley, this means culverts for the drive ways will be needed. I fail to see how it will be possible to have driveways over the ditch without runoff from them going into the ditch , which supports my argument entry to parcels 1 and 2 should be from along the pipeline. I will ask staff today to include our email correspondence to be sent to the planning commissioners as supplemental correspondence. I will also pass on your request (via your email below) to take the matter off the Consent Agenda, however, it will be the Planning Commission's decision to determine whether it stays on the consent agenda or comes off.
