This means to obtain a 50' right of way 5' to the north side of Ashley will need to be obtained <br /> by eminent domain from numerous parcels that lie on the north side, where established fencing trees, vegetation and <br /> power lines are. This will be a lengthy costly endeavor for the county, one that can be avoided, without any burden to the <br /> proposal, by making the subdivision contingent on dedication of 10' of right of way. <br /> The staff report at page 7 speaks of drainage ditch-is this located on the parcels or in the right of way.-this not clear? Is a <br /> ditch required in parcels 1 and 2?Who is liable for incidents stemming from the ditches and for their maintenance? <br /> Second, given that access for parcels 1 and 2 are, per earlier correspondence, apparently is envisioned to be directly onto <br /> Ashley, this means culverts for the drive ways will be needed.
