It appears you missed the point of my comment regarding the right of way width. I understand there is no present intent to <br /> expand the right of way to the north of Ashley. However, now is the time to get the necessary easement for the full 50 <br /> feet, since that is in the long term plan. Why would the County want to have to buy land, disrupt established trees, fencing <br /> and disrupt traffic flow in the future, when it can now reasonably require a dedication from the very development that will <br /> unquestionably significantly increase the traffic on Ashley. The burden to the development is in reality nothing, and the <br /> benefit to the County and the users of Ashley is substantial. <br /> Since as you say the ditch along Ashley will be within the right of way, where there is currently no ditch, it is reasonable to <br /> assume a proper ditch will consume at least ten feet of the right of way, which would put the ditch at the very edge of <br /> Ashley. Obviously, such is a safety hazard. A ditch should be set back from the road edge at least 10 feet. So the way the <br /> conditions are now set, the location of the envisioned ditch will necessarily be hazardous. The hazard would be increased <br /> due to the necessary culverts, which constrain any arc/radius to enter or depart Ashley. The greater the setback of the <br /> ditch from Ashley, the better radius for assess/egress can be achieved.These obvious dangers can be minimized by <br /> increasing the dedication of right of way from 5 feet to ten feet.
