YOSEMITE AVE., MANTECA, SAN JOAQUIN <br /> COUNTY <br /> The California Regional Water Quality Control Board, Central Valley Region (Regional <br /> Board) Executive Officer and staff received Mr. Frank Guinta's and Mr. James Ramsey's <br /> 12 December 2006 Written Response to Cleanup and Abatement Order (CAO) No. R5- <br /> 2003-0713 faxed letter (letter -copy attached). The letter contains comments regarding <br /> the 27 November 2006 meeting with Regional Board staff, to discuss the CAO which was <br /> issued pursuant to Water Code Section 13304 on 18 August 2003. The primary purpose <br /> of the meeting was to discuss a new time schedule for compliance with the tasks required <br /> by the CAO. During the meeting Mr. Guinta and Mr. Ramsey agreed to submit a written <br /> time schedule for compliance by 13 December 2006. <br /> The response letter did not contain a time schedule for compliance with the CAO. <br /> Instead, the letter included the following comments: <br /> • Stated that you lacked the necessary funds to complete the tasks required by the <br /> CAO which you estimated to cost approximately $350,000 to $400,000; <br /> • Requested that you be allowed to retain control over the cleanup using State funds <br /> under the State Water Resources Control Board (State Board), Underground <br /> Storage Tank Program, Emergency, Abandoned and Recalcitrant (EAR) Account-, <br /> • Requested that your consultant AquaScience Engineers Inc. be named the State's <br /> contractor; <br /> • Stated that "Frank found significant pollution (Biological) in the last tests just a few <br /> weeks ago" and requested copies of our sample results from the same wells; and <br /> California Environmental Protection Abend! <br /> Q.p� Rec.vcled Paper <br />
