July 19,2019 <br /> Owens-Brockway Glass Container Inc. <br /> Response to San Joaquin County Environmental Health Department's <br /> June 5,2019 RCRA Large Quantity Hazardous Generator Inspection Report <br /> This was corrected on site. <br /> This is a repeat violation, Class 11. <br /> Response to Item #303: <br /> As stated in the Inspection Report, the two issues listed as Item #303 have been corrected. <br /> Item #406- CCR 66261.7 Contaminated container not marked with date emptied or managed <br /> within one year of being emptied. <br /> The following containers were found empty and not marked with the date they were emptied: <br /> 1. A blue 55-gallon poly drum labeled as ChemTreat CL-2212 located in the basement area in the <br /> vicinity of the oil water separators (IMG 6903-4). <br /> 2. A green 55-gallon steel drum labeled as Biosol 2000 Kleen located in the Forming area (IMG <br /> 6905-5). <br /> Containers larger than five gallons that previously held a hazardous material shall be marked with <br /> the date they were emptied and managed within one year of being emptied. Immediately mark <br /> and manage all empty containers per this section. These empty containers were marked with the <br /> date they were emptied and placed on pallets outside and in front of the Blue Barn. <br /> This was corrected on site. <br /> This is a repeat violation, Class 11. <br /> Response to Item #406: <br /> As stated in the Inspection Report, Item #406 was corrected on the date of the inspection. <br /> Item #502- CCR 66265.192(a) Failed to comply with new hazardous waste tank system <br /> assessment requirements. <br /> Facility does not have a tank assessment for the 1,550-gallon oily water tank. <br /> The owner or operator of a hazardous waste tank shall obtain a written assessment reviewed and <br /> certified by an independent, qualified, professional engineer, registered in California attesting <br /> that the system has sufficient structural integrity, is acceptable for the transferring, storing, and <br /> treating of hazardous waste, and that the tanks and containment system are suitably designed. <br /> Immediately have an assessment prepared for the 1,550-gallon oily water tank. <br /> Submit a schedule showing when this will be accomplished to the EHD. <br /> This is a Class I violation. <br /> Item#503- CCR 66265.192(k) Hazardous waste tank assessment is incomplete. <br /> The hazardous waste tank assessments for the two 1,000-gallon used oil tanks are incomplete. <br /> Tightness testing for each tank and its ancillary equipment is missing.
