The following is an itemized list of hazardous waste violations that have not been <br /> addressed for Yardscape Construction Inc. as of September 28 , 2020 . <br /> Open violations from August 112020 inspection <br /> Violation #101 - Managed a hazardous waste without an identification number. <br /> OBSERVATION: This business does not have a hazardous waste ID number in the California Department of Toxic <br /> Substances Control ( DTSC) database . <br /> REGULATION GUIDANCE: A hazardous waste generator shall not treat, store , dispose of, transport or offer for <br /> transportation , hazardous waste without having received an Environmental Protection Agency ( EPA) Identification <br /> ( ID) Number . A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per <br /> month , less than one kg of acutely hazardous waste per month or any amount of non- RCRA hazardous waste. ID <br /> numbers are unique to a business and site location . <br /> CORRECTIVE ACTION : Go to the DTSC web site at https : //dtsc. ca . gov/apply-for-hazardous-waste-epa-id -number/ <br /> to obtain an ID number. Immediately apply for your ID number and submit evidence to the San Joaquin County <br /> Environmental Health Department within 30 days . <br /> ❑ This violation was corrected ❑ This violation will be corrected by (date) : <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation : <br /> Violation #102 - Failed to determine if a waste is a hazardous waste. <br /> OBSERVATIONS The following wastes were observed from the previous business : <br /> - In the back of the main warehouse , a pile of dust and other debris was generated from the cleanup of the previous <br /> business . <br /> - In the center yard between the warehouses , one blue 55 gallon drum ( 1 /2 full ) contained an unknown solid from the <br /> previous business . <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations (CCR) . There are wastes that are listed as hazardous <br /> wastes . There are wastes that exhibit one or more of the hazardous waste characteristics : toxic, corrosive , reactive <br /> or ignitable . <br /> CORRECTIVE ACTION : Immediately make a hazardous waste determination for each waste , and manage it <br /> according to Title 22 CCR . Use Safety Data Sheets (SDS ) , waste sampling and test results or other knowledge to <br /> support your hazardous waste determination . Waste testing must be done using methods specified in Title 22 CCR <br /> including sections 66261 . 20-24 . <br /> Submit a statement and supporting documentation with your hazardous waste determination . Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes . Provide disposal records for wastes <br /> determined to be hazardous wastes and stored longer than the number of days specified in Title 22 CCR for your <br /> hazardous waste generator status . <br /> Page 1 of 5 <br />
