4 . Groundwater Rights : Groundwater rights shall be dedicated to the MHCSD upon approval of <br /> Improvement Plans . <br /> 5 . Geotechnical Report : All infrastructure designs shall be shown on the grading and improvement <br /> plans and shall comply with and incorporate the recommendations of the Geotechnical <br /> Engineering Studies . The condition shall be met before approval of the Improvement Plans . <br /> 6 . Environmental Hazards : Comply with all applicable recommendations of the Environmental Site <br /> Assessment prepared for the project . The condition shall be met prior to beginning any <br /> construction on the related final map . <br /> 7 . Grading : Except where allowed otherwise by the MHCSD , the grading of the project shall be such <br /> that al-I stormwater runoff shall drain to public streets , public alleys , Mountain House Creek , Old <br /> River , or drainage facilities within easements for storm -drainage purposes . <br /> 8 . Truck Management Plan : Traffic shall comply with the Construction Truck Management Plan <br /> administered by the MHCSD . Project construction plans shall include specifications to the <br /> contractor outlining compliance requirements . A traffic control plan showing construction traffic <br /> routes within the MHCSD ' s boundary shall be provided for approval by the MHCSD prior to the <br /> commencement of any construction . This plan is required from the Developer, the builders , and <br /> all contractors- and subcontracts working within MHCSD ' s boundary . The Developer shall pay all <br /> review fees prior to the approval of the plan . <br /> 9 . U .S . A . Requirement : U . S . A . shall be contacted 48- hours prior to any lateral crossing of a joint <br /> trench or trenching within the right-of-way . <br /> 10 . Hold Harmless Provision : The Developer shall defend , indemnify , and hold harmless the <br /> MHCSD , its agents , officers , and employees , from any claim , action , or proceeding against the <br /> MHCSD , its agents , officers , or employees , to attack , set aside , void , or annul an approval of <br /> MHCSD concerning any MHCSD condition , which action is brought within the time provided for <br /> in Section 66499 . 37 of the Government Code . <br /> b . Best Management Practices : <br /> 1 . The Developer shall comply with MHSWMP policies , MHSWMP mitigationmeasures , _ and Phase <br /> I and II NPDES permit requirements , including the preparation and implementation of an SWPPP <br /> that outlines B . M . P . s to be followed to minimize erosion and sedimentation during project <br /> construction and operation . <br /> 2 . The Developer shall install catch basin filters , Water Decontaminator per MHCSD Standard <br /> Specification and Details , and/or other source control Best Management Practices ( B . M . P . $ ) for <br /> runoff from the project prior to issuance of the building permit . <br /> 3 . Construction - Related Erosion : The Developer and/or contractor shall comply with applicable <br /> NPDES General Construction Activities Storm Water Permit requirements established by the <br /> Clean Water Act . Pursuant to the NPDES Storm Water Program , an application for coverage <br /> under the statewide General Construction Activities Storm Water Permit ( General Permit) shall <br /> be obtained for project development prior to the issuance of grading permits . The Developer <br /> and /or contractor shall obtain coverage under the General Permit by filing a Notice of Intent with <br /> the State Water Resource Control board ' s (SWRCB ) Division of Water Quality . The filing shall <br /> describe erosion control and stormwater treatment measures to be implemented during and the <br /> following construction and provide a schedule for monitoring performance . MHCSD approved <br /> B . M . P . s shall serve to control point and non - point source pollutants in stormwater and shall <br /> constitute the project' s stormwater pollution prevention program ( SWPPP ) for construction <br /> activities . Timing : All applicable permits shall be obtained prior to the issuance of grading permits <br /> for the project . <br /> PA- 2000126 — Conditions of Approval 7 <br />
