Environmental Health Department <br />Small Quantity Hazardous Waste Generator Inspection Report <br />Date: <br />June 11, 2019 <br /> Facility Address: <br /> 2115 W WASHINGTON ST, STOCKTON <br /> Facility Name: <br /> WESTWAY FEED PRODUCTS <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 608 CCR 66266.130 Failed to properly manage used oil and fuel filters. <br />The forklifts are serviced by Gold Coast. According to Andrew Torres, Plant Manager, the contractor takes all of <br />the waste back with them. Only one disposal record from Gold Coast was observed. An email received by the Plant <br />Manager showed that oil filter waste was generated on 6/15/2018. The disposal record was not found on site. Per <br />California Health & Safety Code (HSC) 25163, a valid hazardous waste transporter license is required to transport <br />hazardous waste. Per Title 22 California Code of Regulations (CCR) 66266.130, oil filters that are not completely <br />drained need to be managed as hazardous waste. If the oil filters are completely drained, they can be disposed of <br />via recycling. A bill of lading needs to be left with the facility for drained oil filters. Per 22 CCR 66266.130 (c)(5), a <br />bill of lading needs to indicate: the generator and transporter, the receiving company names, addresses and <br />telephone numbers, the quantity and size of the used oil filter containers transferred, and the date of transfer. If the <br />oil filters are being taken as recycling, immediately start to store the bill of ladings when the waste leaves the site. A <br />copy of each bill of lading must be kept on site for at least three years. Immediately locate a copy of all bills of <br />lading for used oil filters for the past three years, maintain them on site, and submit copies for 2018 and 2019 to the <br />EHD for review. <br />This is a minor violation. <br />Overall Inspection Comments: <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, by July 11, 2019. <br />Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate ($152). To schedule an <br />appointment, please call (209) 468-3420. <br />Waste Streams: Acid waste from tanks, used oil, oil filters <br />The following minor violation was corrected on site during the inspection: <br />Land disposal restriction forms for uniform manifest numbers 010893174FLE (propionic acid, 6/1/2017), <br />010277934FLE (phosphoric acid, 1/5/2017), and 010277935FLE (phosphoric acid, 1/5/2017) were found without <br />signatures from the generator. The forms are required to be signed by the generator. Ensure that the forms are <br />completed for all future shipments per Title 22 California Code of Regulations 66268.7.
