The following wastes were brought from his business's previous location and were being stored in the <br /> back area at his current location: <br /> -One blue 55 gallon poly drum containing diesel waste (1/2 full) <br /> -One white 55 gallon poly drum containing diesel waste(full) <br /> -One white 55 gallon poly drum containing used oil (1/5 full) <br /> -Four black 20 gallon metal drums containing used oil (full) <br /> Hazardous wastes shall be disposed of only by transportation to a permitted hazardous waste treatment, storage, <br /> and disposal facility(TSDF)or other authorized point. <br /> REGULATION GUIDANCE: Any person who knowingly transports or causes the transportation of hazardous waste, <br /> or who reasonably should have known that he or she was causing the transportation of any hazardous waste,to a <br /> facility which does not have a permit from the department issued pursuant to this chapter, or at any point which is <br /> not authorized according to this chapter, shall, upon conviction, be punished by imprisonment in a county jail for not <br /> more than one year or by imprisonment pursuant to subdivision (h)of Section 1170 of the Penal Code. <br /> CORRECTIVE ACTION: Immediately cease transportation of hazardous waste. Provide a corrective action <br /> statement to the San Joaquin County Environmental Health Department within 30 days. <br /> This is a Class II violation. <br /> 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. <br /> OBSERVATION: The wash bay area on the west side of the facility was covered with heavy oily staining. <br /> REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the <br /> possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous <br /> waste constituents to air, soil, or surface water which could threaten human health or the environment. <br /> CORRECTIVE ACTION: Immediately clean all saturated oil spots. Manage the waste according to Title 22 <br /> California Code of Regulations for hazardous waste.
