The following is an itemized list of hazardous waste violations that have not been addressed for GILS AUTO REPAIR as of January02 , 2020 . Open violations from October 28, 2019 inspection Violation #101 - Managed a hazardous waste without an identification number. OBSERVATION This business does not have a hazardous waste ID number in the California Department of Toxic Substances Control ( DTSC) database . REGULATION GUIDANCE: A hazardous waste generator shall not treat, store , dispose of, transport or offer for transportation , hazardous waste without having received an Environmental Protection Agency ( EPA) Identification ( ID ) Number . A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per month , less than one kg of acutely hazardous waste per month or any amount of non -RCRA hazardous waste. ID numbers are unique to a business and site location . CORRECTIVE ACTION : Go to the DTSC web site at https : Hdtsc. ca . gov/apply-for- hazardous-waste-epa-id -number/ to obtain a State ID number , Immediately apply for your ID number and submit evidence to the San Joaquin County Environmental Health Department within 30 days . ❑ This violation was corrected ❑ This violation will be corrected by ( date) : ❑ Supporting documents included Describe actions taken or will be taken to correct violation : Violation #102 - Failed to determine if a waste is a hazardous waste . OBSERVATIONS Oily gravel , sanding dust and waste paint are generated by this facility and need a hazardous waste determination . REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste as specified in Title 22 California Code of Regulations ( CCR ) . There are wastes that are listed as hazardous wastes . There are wastes that exhibit one or more of the hazardous waste characteristics : toxic , corrosive , reactive or ignitable . CORRECTIVE ACTION : Immediately make a hazardous waste determination for each waste and manage it according to Title 22 CCR . Use Safety Data Sheets (SDS) , waste sampling and test results or other knowledge to support your hazardous waste determination . Waste testing must be done using methods specified in Title 22 CCR including sections 66261 . 20-24 . Submit a statement and supporting documentation with your hazardous waste determination . Demonstrate current storage and labeling for wastes determined to be hazardous wastes .
